Subject : Elizabeth McMahon and Overhauling the Davis Stirling Act
As you all know, Legislation is often a matter of "who gets the power." As a consumer and member of a Homeoners Association, I often wonder who truly represents us.

It certainly is not ECHO, CACM, CAI, or CLAC. And it certainly won't be any lobbyist.

As consumers and real HOMEOWNERS are not interested in imposing greater controls over their neighbors. Nor are they interested in imposing more financial liabilities.

Where are our Hero- Heroines?

While I was in law school in the early '60's I remember a property professor extolling the virtues of real property law saying " It was constant throughout history.

Everyone, including the title company, knew where they stood." Of course, this professor didn't teach constitutional or environmental (was there any) law.

I do believe we need a good, old fashioned debate - not Jerry Springer - to determine where we're going with respect to homeownership.

I suggest that the Assembly and Senate relook at Davis Stirling, pre implications of Narhstedt, Non-profit (? )Association, complete disclosure, democracy or autocracy, etc.

Or maybe legislators are again going to contribute to our cynicism ?

Two Bills AB 860 and AB1048 are being considered .

That's a start - but frankly we need an overhaul, not an injection.

There are too many loopholes in the current legislative framework.

And I suggest you involve a lady Joan of Arc - Elizabeth McMahon.

No, she's not a client; never been.
