Dear Senator Speier:

President Elect George Bush appointed Mel Martinez, a former Cuban refugee to head HUD because he said, "Homeownership lies at the heart of the American dream and they want very American to share that dream."

This is ironic because we now know HUD helped destroy the American homeownership dream in the sixties when they secretly planned a social experiment in housing now called a CID, under a quasi-government known as the homeowner association.

The state has a duty to be sure there is no conflict of interest in any insurance company as pointed out in the hearing on Chuck Quackenbush.

The first question is:
WHY CAI has co-sponsored Chubb with so much special interest this billion-dollar company owns 80% of all HOA policies nationwide(42 million mutual-interest policy holders) giving them a monopoly.

The second question is: Why the California legislature ignored the fact, CAI- Chubb sponsor was sued for unfair business 1991-1994 yet the California legislature rolled out the royal carpet for Skip Daum and his CAI/CLAC lobby group that continued to rape 6 million homeowners in HOAs, with a state blessing?

Every HOA is supposed to comply with "Mutual Benefit" codes and how can anyone find a mutual benefit in taking large sums of money away from individual residents of CIDs so the Board Directors can afford to sue the residents who own the nonprofit corporation for legal profits?

The third question being ignored is covered by the recent Supreme Court Election Decision on the ballot confusion.
The Supreme Court made it clear ALL NINE judges felt ALL citizens did not receive "equal protection" which is a federal right.
Can any of you show me or show anyone where HOAs give equal rights to any of your six million residents?

Every lawsuit I have investigated on my own time out of my own pocket since 1985 has shown every action filed was on the basis of vendetta, a race issue or sheer profit for lawyers now boasting they earn millions instead of thousands.

The Davis-Sterling Act should be repealed because it was a direct violation of the Fair Political Practice Act which states no special interest can influence any bill that has any financial or material gain and Gray Davis pushed that bill to enrich himself and other lawyers at expense of defenseless homeowners.

Davis should be impeached anyway...voters condemn Clinton for allowing contributors to use the Lincoln room, but it well known that Gov. Davis doesn't have anyone breakfast, lunch, dine or golf with him unless they cross his palm with silver to keep his contribution chest running over for his next election.'

California Judges have been awarding the Board hiway-robber-law-firms huge awards that leave the homeowners homeless and bankrupt on the excuse they cannot interfere in a "private contract."

McMahon missed the boat in failure to argue all HOA contracts are void-invalid-because because any contract that eliminates equal protection and due process is unconstitutional.

Each of you have pretended these contracts are valid to support the billions of free property tax dollars flowing into each county assessors office they don't have to use for infrastructure.
This is a blatant tax discrimination, far worse than the tea tax that resulted in the Boston Tea Party.

Discrimination is against the state and federal law yet you were well aware many highly publicized racial discrimination cases like Elizabeth McMahon and Alisa Ross, had no basis except race-and not one California agency has taken any action to punish or stop this abuse.

I myself published many cases from 1985 until 1995 and the Commission of Human Rights was the only agency in the state to care.

They made some radio and TV broadcasts seeking help in an effort to educate the public HOAs hide behind the CC&Rs to practice race discrimination and get away with hate-crimes.

I personally saw blacks, Indians, Asians and Hispanics become victims of boards suing them over fake CC&R violations because they wanted an all white-protestant or Catholic resident community, and that has not changed.

The only change in ten years is in Arizona where three board members were shot to death and two wounded because Arizona legislation waited to long to eliminate gulags...

Nevada has also opened it's door to justice for all with public hearings but they did not act till they had so many HOA foreclosures they couldn't rent or lease units for balance owed.

The only description of the organized theft carried out daily with CAI/CLAC/Chubb lawyers is racketeering.

The press screamed front page stories on the millions of homeowners who fell victims to unjustifed nonjudicial foreclosures.
One Orange County Lawyer, Larry Rothman boasted he foreclosed on 250 HOA homes per month. Lawyers pick them up or use a shell company to buy them for a song to rent or sell at great profit then write large contributions to leaders like Gov. Gray Davis to get more profit-making protection like the Davis-Sterling Act...

There is no one with assurance like the man who sells insurance but in this case it does not take a committee to detect CAI is so chummy with Chubb they help them steal all HOA insurance because of profits, not protection.

I find it hard to understand how anyone can permit a mutual benefit to collect equal payments from it's homeowners to buy a policy that makes it safe for them to leave any of those helpless homeowners homeless.

Each elected official and each state hired employee has taken an oath to protect the health and welfare of all citizens not just those who pay for elections.

CIDs are being built on swamp land, landslides, earthquakes, etc daily with protection of insurance firms quite aware of the risk.

This is bad faith of the worst kind because homeowners have no access to the fact many of these CIDS like Palacio del Mar in San Clemente were granted a permit to build hillsides homes on man engineered hillsides that sit on a landslide.

The earthquake victims Quackenbush deprived number far less than the HOA victims of every calamity in the book like landslide damaged homes finance at over priced sales from $450,000 up
.

The golden state has led the way in allowing dreams to become a nightmare of horrors and you have a choice. Act now in a open hearing or get caught by a new congress after the holiday as websites continue to educate and alert homeowners to unite in a class action case against the racketeering and discrimination that has eaten their life savings and stolen their homes.

I lost money on my Lake Forest Home in CA to save of mind and become a free American again.

I also spent a good deal to rescue homeless victims who did not have a dime to eat or pay for shelter even though my fixed income is only a small military widow's pension, most elected officials would not accept as pen money.

Charity begins at home and I fed those who were hungry and provided free beds and shelter to victims of over zealous boards blinded by greedy lawyers who keep the local sheriff rich hopping to serve foreclosure evictions.

I have only one regret. I never kept a video camera by my door to video the shocked faces of those evicted with only the clothes on their back, no where to go, no money left to move with.

They are the new refugees but they don't get any sympathy like aboy called Elian...because the clever brokers and buidlers trapped them into signing misleading contracts you can look at and say, "Sorry--we can't interfere in contract rights."
The contract that counts is the contract between every elected official and every constituent for equal protection and consideration and that contract is broken every day for special interests.

Chuck Quackenbush never had a fraction of the profit through insurance of earthquake victims compared to the fortunes of the CAI-Chubb partners for profit.

How do you think Chubb paid former President Geoirge Bush so much money to sell their insurance in China....?
How many insurance companies can afford to use a former president as a salesman overseas?

I realize you are caught between a rock and a hard place, I have been there, done that and seen that...but how many more will line up homeless before action is taken?? Maybe the new HUD Secretary can investigate the role of HUD under the old one...we will call on him as soon as he unpacks. After all, maybe it takes a former refugee to help protect Americans from becoming new refugees because he has the advantage of having walked in their shoes and he knows how painful it is.
