Judge Michael J. Kaplan, the presiding judge on Case No: 95-10486 - AP 96-91030 - George Harder v David Peters, Carlos Sosa, Desert Breezes Homeowners Association et al. - was asked to decide whether the non-judicial forecloure sale by Desert Breezes Homeowners Association was properly conducted under California Civil Code Section 1367 and 2924. He wrote the following about David Peters and Keenan Parker of Peters & Freedman:
....I note the "disessembling, disingenousness, mischaracterization and misrepresentations....that characterizes the earlier written record....It seems that you cannot be trusted to represent yourself civilly and in good faith here. Consequently I revoke the authority of my November 8, 1996 granted the law firm of Peters & Freedman or its individual members or associates to submit evidence directly to me in this matter.From now on all submissions shall be through your counsel Mr. Latin, who shall sign all submissions under Rule 11. (Of course he cannot join in affidavits, but he can make his own reasonable inquiry of you as to the basis and veracity thereof.
Judge Kaplan rules that the non-judicial foreclosure sale that Peters & Freedman conducted on George Harder's home was not properly conducted under California Civil Code 1367 and 2924
