Dear Michael Kim - Peters and Freedman:
Would you please stop lying. Your latest lie - brazen and unequivocal - is shocking.
Lie # 1- February 25, 2005 - Lie To JAMS Judge David Brickner
XXXXX XXXXxn asked you at his deposition on February 25 2005 to stop asking questions that had already been asked at the first session of his deposition.
You stated to Judge Brickner that you had not been present at that deposition. That was a flat out lie. You were present the entire time, taking notes and advising while your partner, Simon Freedman, asked the questions. The deposition transcript states that you were there. It is incredible how you lie.
But that is not the first time.
Lie # 2 - February 24, 2005 - Lie To JAMS Judge David Brickner
At the same deposition on February 24, 2005 you stated to Judge Brickner that the underlying case had been primarily about an alleged architectural violation regarding terrace walls on the slope. Once again, this is not true.
Other lies are even more serious because you made them under penalty of perjury.
Lie # 3 - July 2004 - Lie To Judge David Brooks - Orange County Superior Court
On or around December 29, 2004, you also committed perjury by swearing under penalty of perjury that you had given the required notice to a defendant regarding an ex parte hearing, when in fact you had not.
Lie # 4 - July 2004 - Lie To Judge Michael Brenner - Orange County Superior Court
For example, In your motion for appellate attorney fees and costs, you included over $30,000 of attorney fees and costs from a completely different case. Judge Brenner ordered that they be excised. You had sworn under penalty of perjury that they were appellate fees and costs, when in fact they had nothing to do with the appeal.
There will be a day of reckoning for these and other lies that you routinely propound. To avoid further damage, it might be a good idea stop lying right here, right now. If you were genuinely sorry, you would seek to make amends.
