19. A petition on the internet for all Coloradans to sign which will abolish HOAs

"Even if there were a law that required HOA's to allow homeowners to record meetings, if the board decided to violate the law, homeowners will have to sue. That is no solution."

That's absolutely true! And we had all better begin to accept that fact that ALL HOA boards of directors and ALL members of their cabals know that.

But we homeowners have something going for us that HOA boards and their cabals don't have in the same way we do. And that is a the internet and other public forums to tell everything we beleaguered homeowners have learned about corrupt HOAs and their supporters over the years. We just need to tell the TRUTH and FACTS and LAW (insofar as we know the law) about those who are members of what has come to be known as the "HOA Industry." And that truth, facts and law is that they are all CORRUPT TO THEIR VERY CORES.

"The solution is abolishing "corporatized" housing and returning the American Dream of home ownership to its rightful owner - the HOMEOWNER. We must return to building homes in the traditional fashion of utilizing property taxes (that are a tax write off) to pay for and maintain the infrastructure, and to be able to do business with a municipal entity that is bound by open meetings acts, rules of order, etc. etc. BAN HOA'S!!"

YES !!!!! And that's exactly what I'm trying to do here in Colorado by putting a petition on the internet for all Coloradans to sign which will abolish HOAs, now and in the future, in the state of Colorado.

18. We must return to building homes in the traditional fashio
Even if there were a law that required HOA's to allow homeowners to record meetings, if the board decided to violate the law, homeowners will have to sue. That is no solution.

One has to ask the question, why did it get this way to begin with? The solution is abolishing "corporatized" housing and returning the American Dream of home ownership to its rightful owner - the HOMEOWNER.

We must return to building homes in the traditional fashion of utilizing property taxes (that are a tax write off) to pay for and maintain the infrastructure, and to be able to do business with a municipal entity that is bound by open meetings acts, rules of order, etc. etc.

BAN HOA'S!!

17. America's homeowners appear to be up against is massive local and state racketeering and other corruption
  Username withheld in California,

"Some homeowners report they are: Identifying the State, Federal and International criminal code violations and filing criminal complaints with the authorities, courts, and related organizations and individuals..."

EXCELLENT IDEA!!! I believe that involving ourselves in RICO (criminal) actions and RICO (civil) lawsuits may be a constructive way to go. Why? Because what we homeowners appear to be up against is massive local and state racketeering and other corruption. California, as you may already know, is already beginning to bring such actions in federal court.

"Working to elect politicians and judges who are not on the homeowner association foreclosure industry wagon"

YES !!! That is a MUST since our politicians and judges (and CAI lawyers) are the main "players" in continuing the existence of dictatorial HOAs.

"The negative reports about homeowner associations on the internet is already deterring millions from buying houses with homeowners associations."

Yes, so I've read and heard. I hope their numbers climb to the MILLIONS.

"The mass international internet HOA exposes, and election changes should help curb some of the homeowner association fraudulent foreclosures"

Agreed!!!

16. Homeowner Associations: Mass "Notices of Fraud • Demand for Investigations • Demand for Restitution" and Mass Internet Exposes
  Response to Jan Jackson's Comment # 15:

Some homeowners report they are:

• Identifying the State, Federal and International criminal code violations and filing criminal complaints with the authorities, courts, and related organizations and individuals

• Doing "Notice of Fraud and Demand for Investigations and Demand for Restitution" and sending it to all the individuals including the lawyers, judges, insurance carriers, banks securitizers, investors etc, local, national and international agencies (Department of Justice, Banking authorities, Congressional Committees, IRS, FBI, District Attorneys, Attorney Generals, Judicial authorities, political authorities etc.)

• Filing their own lawsuits, including RICO

• Working to elect politicians and judges who are not on the homeowner association foreclosure industry wagon

Some say they will publish them on AHRC when ready

The negative reports about homeowner associations on the internet is already deterring millions from buying houses with homeowners associations.

The mass "Notices of Fraud and Demand for Investigations and Demand for Restitution" deposited with authorities, and the mass lawsuits, the exposure of corporate and judicial crimes should provide an impetus to the complacent or colluding government and corporate authorities begin to do their jobs they are paid to do whether it is servicing , protecting or delivering justice.

The mass international internet HOA exposes, , and election changes should help curb some of the homeowner association fraudulent foreclosures

15. So, we will fight to live that way until we draw our last breath
  Username withheld in California,

Having experienced almost all of the "horrors" that have to do with HOAs, I want to tell you that I agree wholeheartedly with everything you said. It's all true ... and more!

The question for me, tho, has always been, "What can I *do* about it?" So, over the years, I have tried various things, including, recently, filing a lawsuit and going to trial against my HOA. All failed. I have now filed my Notice of Appeal at appellate level. I may lose there too, especially in light of what you just wrote.

So, here's my thinking now: I will continue to fight this tyranny called "homeowners associations" (and other corruption in these United States) until it becomes very, very clear to me that our country has gone "down the tubes." At that point, I (and others) will "fold my tent and silently steal away" where no one can ever find me. But where I and others will continue to fight ... in a different way.

My ancestors came to this hope-filled land in 1612. It was never easy for them, and it won't be easy for me (or others) now. But we know no other way to live but in freedom and liberty. So, we will fight to live that way until we draw our last breath. My two sons, and their sons and daughters (and others sons and daughters) will do the same after we're gone.

14. My Homeowners Association even has a policy AGAINST recording any meetings.
  Username withheld in Pennsylvania,

"Technical difficulties" and all kinds of other "difficulties" can, and will, crop up with only one tape of the meeting available (that the board itself recorded). The "fix" for that, imho, is for another member of the HOA -- preferably a dissenting member -- to ALSO record the meeting. I have suggested that many times to my HOA board, but they totally refuse to record any meetings whatsoever. And, as I believe I mentioned in my press release, my HOA even has a policy AGAINST recording any meetings.

13. America's home foreclosure fraud and the many faces America's roving band of foreclosure lawyers
Re: Comment 12: The Court did not want to hear about the HOA lies

The Court i.e. judges are one face of the roving band of foreclosure lawyers (other faces: developers lawyers writing illegal land sales contracts, HOA lawyers, collection-foreclosure lawyers, insurance lawyers, lobbyists, brokers, rental judges, law makers etc) and are part of the the home foreclosure fraud collapsing the economies of the world..

In California the foreclosure lobbyists finance the elections of the governor. The governor appoints foreclosure lawyers as judges.

Homeowners are routinely hauled into California courts every day and falsely charged with "homeowner association rules violations" by homeowner association lawyers and fleeced by the judges and the lawyers.

The lower court judges "fix" cases so homeowners have to pay hundreds of thousands and even millions in fraudulent HOA "lawyers and court fees" and their own lawyers fees if they are no on some contingency agreement.

When the homeowners appeal, the appellate judges ( HOA lawyers who worked in the lower courts now promoted to 'justices') write false, unpublished, to multiply the HOA's "lawyers and court fees".

The California Judicial business is the biggest litigation foreclosure business in the world.

Pro-homeowner lawyers openly warn their clients "Courts are for judgments not justice".

America's Judicial System is one big unregulated, wealthy family of unethical lawyers masquerading as governors, lawmakers, judges and lobbyists, all covering each others backs and working in unison to fleece and foreclose on homes and defraud international investors for fraudulent lawyers fees.

12. The court didn't want to know about the HOA lies!
  Dear Username Witheld Phoenix,

YES, I too, have experienced the, "we had technical difficulities with the tape of that years meeting," and therefore it BECAME unavilable! Believe that one and I am sure I can sell you a bridge in Brooklyn! I didn't get it at first. There was another copy though, from the other association. When this one was finally located, the court didn't want to know about it! The tape was even transcribed for their lies to appear in writing!
EVERY PROPERTY OWNER IN AN ASSOCIATION SHOULD RECORD EVERY MEETING!!!

11. "irresponsible adults" who call themselves "HOA board members" first need to be EXPOSED
Username withheld in Phoenix, Arizona, wrote:

"The comment was how ludicrous this was, in both fostering community, and in how responsible and even irresponsible adults should relate to each other, since they are, after all, adults paying a mortgage for those homes and properties, not children."

Very true! As you already know, however, these "irresponsible adults" who call themselves "HOA board members" first need to be EXPOSED for exactly who and what they are before they will lose that controlling power.

You and others are doing an EXCELLENT job of exposing them all! :-)

10. Don't show me any property or homes in an HOA-CIC
Username withheld in Phoenix, Arizona, wrote:

"Guess we haven't heard of 'technical difficulties' or 'we lost the tape,' or the missing minutes from the Watergate tapes...."

In my HOA? No, not yet. But I feel pretty confident that we will IF they (my HOA BoD and their cabal) ever decide the issue is getting too politically hot to handle. And that might well happen soon, what with the publicity that is being generated here in my area of Colorado and throughout the state of Colorado about the corrupt "governance" of HOAs-CICs. They appear to have backed themselves into a political corner about this issue whereby they are "damned if they do and damned if they don't", imho. Not a very comfortable place for either an HOA board, the board's cabal, or the board's CAI lawyer to be in, eh?

"...when you are dealing with tyranny on any level, those individuals do not play by the rules or even acknowledge the rules, they make up their own, or use their positions of public trust for personal gain."

True, BUT "public trust" of ANY public official, these days, has already gone down the toilet. They've blatantly screwed around with the Constitutional and legal rights of We The People for so long that We The People are finally beginning to say, "NO MORE!!"

"Unfortunately the 'advisors' normally are 'advising' them on how to skirt around the laws, not abide by them themselves."

Exactly! However, these days We The People appear to know that -- especially after our years and years of "educating" them about it. :-)

"...how many people in these communities, would again buy a property in one, with all the losses of their ownership rights, privacy, and freedom given what they know now, or how these 'contracts' have been statutorily amended even, without their consent?"

Not many, and we're already seeing that happening in Colorado. Informed (by us homeowner advocates) home buyers are telling their real estate agents, "Don't show me any property or homes in an HOA-CIC." :-)
