The polls should be closed before opening any ballots.
All you can do is take your HOA to small claims court under the new election law. Very easy to do! Counting and Tabulating the counting the ballots.Have the last ballot not counted or the whole thing thrown out.
And start over with everyone recieving a ballot. Make sure you campaign against the assesment and put up political signs: Vote NO!

And in many, due to 'SafeHarbor' statutes, and 'agent' status of the principals in these Associations, don't even happen at all...
I lived 12 years in a community where, although they were provided for, there were no votes for major improvements, annual assessment levels over the maximum allowed w/o vote, etc., the annual meeting and budget review held in the middle of the year, rather than at the beginning.
It seems this new TOO local 'government' takes it's advice and cue from those advising their big brothers - holding meetings, hearings and elections when, due to work schedules and such, few will be able to attend (or change the times of the public hearings), impose taxes without required votes or at the very least, sufficient opportunity and public notice for input, etc.
It doesn't seem HOA elections are any different than our regular elections (mail in ballots kept in backrooms, computers tampering, voter fraud). The city government places placards for bond elections and such in order to get their agendas passed, who receive and then count those votes, so don't know why you'd need an expert, when 'clean elections' have been a pipe dream for the general public at every level, the corruption now reaching unprecedented levels.

There are now expert witnesses on HOA elections? As an attorney, it would appear, wouldn't each individual election, and what occurred, be simply a 'fact' in the case according to the provisions in the documents for elections, or state law as it now exists either supporting or invalidating it (as actual created governments now by giving state support of these 'servitudes'), and the amount also simply a 'matter of fact' either substantiated or negated by market price, or the actual bids?
How can you be an expert in HOA elections, when each election and the circumstances surrounding same, most likely would be different, and merely a 'fact' matter based upon the evidence of the witnesses to what occurred. What could any 'expert' add, except many elections are 'clean' and many are not?
