Re SB 244:
Senator Tommy Williams of the Woodlands added the amendment to HB 244 so that, if passed, the bill would not have applied to Harris County NOR its surrounding counties. He is the real crony of Senator John Corona of Texas!
To Wit:
Amend SB 244, in SECTION 1 of the bill, in Section 209.009, Property Code (committee printing page 1, between lines 28 and 29) by adding a new Subsection (c) to read as follows: (c) Subsection (b) does not apply to a payment received by a property owners' association if:
(1) membership in the property owners' association is mandatory for owners or for a defined class of owners of private real property in a defined geographic area in a county with a population of 3.3 million or more or in a county adjacent to a county with a population of 3.3 million or more;
(2) the property owners' association has the power to make mandatory special assessments for capital improvements or mandatory regular assessments; and (3) the amount of the mandatory special or regular assessments is or has ever been based in whole or in part on the value at which the state or a local governmental body assesses the property for purposes of ad valorem taxation under Section 20, Article VIII, Texas Constitution.
Re Fair Debt Collection Act:
1999-Arizona--Test for Fair Debt Practices Collection Act as it applies to an HOA. Oh, it applies....but they have a legal loophole: an HOA is not a debt collection agency!

Carona and his ilk should be tried for insider trading of our constitutional rights.
HOAs are little more than "perpetual contracts" that fund a police state wherein all powers of legislative, executive and judiciary are held in one hand. Perpetuities are forbidden by our constitution...these are the ways of the feudal system that the wars of 1776 spawned. Americans forgot what kind of absolute tyranny this kind of "contract" brought to our society. We're destined to repeat those horrors, and fight another war if we turn our backs on the constitution.
Fascism is upon us...Carona and the CAI are what kind of Despotism America has to fear - they ignore the constitution and promulgate "perpetuities and monopolies" on all new housing...Mandatory Associations Foreclosing in America. Better known as MAFIA.
Put it to a vote in every neighborhood - if 51% agree to extend the contracts, then I'll accept that. But we're never given a vote about the mandatory HOA thing - and that is where this "manufactured consent" must be called into question. I never agreed to the MAFIA concepts...did you? Speak up then.

FROM May 24, 2005, p. 4310 of the TEXAS Legislative Journal:
"SB 244 - POINT OF ORDER
Representative Harper-Brown raised a point of order against further consideration of SB 244 under Rule 4, Section 33 of the House Rules on the grounds that the committee report for the bill does not contain a fiscal note. The chair sustained the point of order. The ruling precluded further consideration of SB 244."
NOTE: Representative LINDA HARPER-BROWN is the Vice Chair for the House Committee on Land & Resource Management. This Committee and the Business & Industry Committee together form the Property Rights Committee.

Thanks again AHRC for getting the facts out about this group and their particular brand of cronyism.
The problem with our Attorney General is that he takes too much in contributions from CAI/ULI affiliated land/management companies.
Perry homes alone, which has many communities managed by this CAI group is one of the biggest givers in the country and especially to our governor and Attorney General. No luck going to them, maybe the feds?
