Summary: While employed by Palacio del Mar homeowner, John Marshall Kremer, without informing the homeowner, gave the Marquis Management - U.S. Consolidated Collection & Foreclosure company (both went out of business shortly after the lawsuit) defense lawyer Julius Dix extra time to respond to respond the lawsuit. Dix then wrote a letter thanking Kremer for giving him 60 days. Kremer told the homeowner he did not give him 60 days and that the law only allows only 30 days. Shortly after Kremer withdrew from the lawsuit.
Other Information: Kremer was employed by Palacio del Mar Homeowner to defend a fraudulent foreclosure case by Palacio del Mar Homeowners Association Board members (Malcolm Gillies, disbarred lawyer John Meyers et al) and Diane Fullerton, Toni Daughtry, Pat Gummeson of the now defunct Mercury Property Management - Marquis Management - U. S. Consolidated Collection and foreclosure Company. The defense lawyer was Julius Dix. When the cross complaint was served on Marquis office, Kremer was present. Unknown to the Palacio homeowner, Dix asked Kremer for an extension for a reply and the wrote a letter thanking him for giving him 60 days. Kremer then withdrew from the case. At a Palacio del Mar HOmeowners Association discovery hearing by the CHUBB insurance defense lawyer Neil Gunny, Dix told the homeowner he did not have a case against his client Toni Daughtry because on the day she was served, she had already left the employ of U.S Consolidated and Marquis Management Company. Latter was false as Daughtry was still at employed at Marquis when the complaint was served. When told this Dix, pulled out the complaint Kremer filed in court saying the service date showed a date after Daughtry had left Marquis.
