Judge Kenneth Ziebarth, a retired Superior Court judge, a JAMs rental judge and a travelling judge for the California Superior court assisted Peters & Freedman by masterminding and piloting the Palacio del Mar case. David Chaffee , the judge on the Palacio del Mar case assisted Pratt by: making unjust rulings, cutting off the defense lawyers and witnesses and refusing to let them testify at trial, and coaching Pratt, using descretationary powers to make rulings to help Peters & Freedman and supress the r ights of the homeowner to a fair trial before a jury or have a cross complaint, RICO case against Peters & Freedman.

Other Information: David Peters misrepresented to homeowners in the Palacio del Mar HOA that a proposed amendent to the governing documents was solely meant to create staggered voting for the board of directors. In fact, it also eliminated the culmulative voting rights of homeowners in order to prevent a homeowner from being on the board and from seeing the financials of the association.
The board and management company were doing telephone transfers, misappropriating reserves, concealing lawsuits from owners, paying board members (John Meyers) to do legal work in violation of codes, letting board members and select members fence in common areas to make their lots look much larger and have more value, using homeowner funds to do improvements around theirs and their family member properties, using vendors (lawyers and managers and landscapers) for personal and political benefits, fabricating records, lying in minutes, discrimminating, and damaging the owner's property.
The board triple reserved association reserves to $350,000 to create a war chest to finance a discriminatory and unfair lawsuit against an owner in order to keep their control of the association, and to continue hiding books, records and frauds.
Jeffrey Pratt worked for Peters & Freeman and litigated a case against an owner who was told by Marquis president Pat Gummeson, "Hell will freeze over before we do anything for you", whose home was spray painted , who was asked to move by long term board members, and denied services and repairs over many years.

Pratt left Peters & Freedman 2003 , reportedly after testifying against David Peters in the San Diego sewer hookup case.

We celebrated our wonderful 43 years together on 16 Jan 03. As of this date I have not been able to find out any additional information on the filing by Peters and Freedman.
I have not been able to get any type of cover letter they used to file this document. I know it is fraud because it was prepared after Judge Fry stated in his decision that this is not a Davis-Sterling Mobile Home Park.
I have not give up and will continue to see if I can get correspondence from Peters and Freedman on this document.
I intend to contact the Secretary of State legal department and file a complaint.
I also will contact the California Bar and see about filing a complaint on this matter. I think when this document was filed Peters and Freedman represented Desert Crest Country Club and Desert Crest Community Assocation. I must verify this also.
I will keep you updated on everything I find out, also on any actions I take as relates to this document.

Pratt cases need to be scrutinized and he needs to to be reported to the bar.
Chaffee needs to be thrown off the bench. If everyone he pulled his non-imparial, CAI biased, make-up-the-laws-as-he-goes-along brand of Stalin-like reign, then something would be done.

This division DOES do something about bad judges, look at Public Discpline page if you doubt it. What are they going to do when they start getting droves of complaints?

Jeffrey Pratt represented the Palacio del Mar Homeowners Association in San Clemente, California, against a homeowner.
The association was overwatering the front yard of the owner. The owner's house had moved 12 inches down the slope, and tilted to one side by the same amount. The water lines, the gas lines and the sewer lines broke. The insurance company cancelled the homeowner's policy as a result. The houses next door dropped to 50% of the value and the city yellow-taggged one. The association below Palacio (Presidential Heights) had filed a suit against the Palacio HOA and individual homeowners. It lasted ten years. The judge for that case put an injunction against Palacio del Mar for watering .
The homeowner asked the association to stop overwatering her yard. When the sewer lines of the neighbor broke, the association turned off the water valve that was located on her yard. The neighbor's lawn still stayed green.
When the association came to turn the water back on, the owner again asked the association not to overwater. They refused. The owner refused to let them turn on the three sprinkler heads in her private yard.
The association had lied to the owners and triple reserved the HOA. There were charges of misappriation of dues and fraudulent changes of CCRs by the board, managers and lawyers. They had lied to the owners and overchaged dues and accumulated $350,000 in their war chest.
A retired judge, Kenneth Ziebarth, moved into the association. Together with Pratt (Peters & Freedman), Ziebarth masterminded a lawsuit and with the help of a friendly judge, David Chaffee, railroaded the homeowner through the Orange County Court system.
Chaffee browbeat the homemowner's lawyers in court, coached Pratt during the trial and gave him over $200,000 in lawyers fees.
The homeowner has appealed the case. Pratt's bar record indicates he has left Peters & Freedman and is using a P.O. Box for contact.
