City of San Clemente Engineer's report says that the whole slope below this home is sliding.
The current buyer of this home was sued by Peters & Freedman alleged "ARC violations". They had done nothing. After harassing the new owner with an avalanche of legal proceedings and invasive depositions and running up a huge legal defense bill for them , Peters & Freedman told them they would make the case go away if she paid Peters & Freedman legal bill of $24,800. and signed an agreement to:
take liability of the sliding common area homeowner association slope
indemnify insurance companies, Peters & Freedman, the City of San Clemente and the board members of any slope failure liabilities
pass on the slope liability new homebuyers of their home
tear down a room when she sells her home - the previous owner spent over $40,000 10 years ago to build this room with written city permits and homeowner association agreement.

Other Information: Peters & Freedman sued the previous owner for " homeowner association easement rights" to her private yard so the association could continue overwatering her property.
The homeowner lost the case as a result of bad representation, insurance company lawyers colloboraton, a board member Judge Kenneth masterminding the lawsuit, perjury, witholding evidence and a biased trial judge - David Chaffee.
The homeowner paid the the judgement as soon as the court determined the amount. After collecting $240,000. in fees and 10% interest Peters & Freedman is now claiming they want over $250,000. in additional "legal discovery bills" claiming the owner sold her home "below market value" to "avoid paying legal fees the owner knew Peters & Freeman may be due with the case concluded" after the owner had paid them in full and without any delays.
The homes on either side also had the same major structural damages from sliding slope ,(one was condemned by the city). All were sold at below half the market value as destressed property by the owners after sewer, gas and water lines began breaking up under the homes and in the association street in front of the homes.
Notes
There is not drainage in Palacio del Mar HOA. The board put in a massive sprinkler system that damaged many of the Palacio homes and the homes below in Presidential Heights Homeowners Association. Twelve Palacio homeowners sued Palacio and won settlements. Presidential Heights Homeowners Association also sued Palacio and won a major settlement. They used the settlement to build a drainage system for their homeowners association to divert the water into the City of San Clemente drainage system rather than under their homes.
Palacio still refuses to put in drainage. Most of the reserves are used to finance Peters & Freedman's lawsuits against targeted owners.
There are damaged homes bought for as low as $197,000. being sold for $1.25 million dollars without any structural repairs.

Mr. Hess resume states he works in San Diego, Los Angeles, Riverside, and Orange Counties as an expert in " stigma loss" He says he has been deposed over 500 times, worked for 700 attorneys , testified in court approximately 120 times and done approximately 25 arbitrations in the past 23 years.
Mr. Hess is Peters & Freedman's "expert" to show the market value of the home a Palacio del Mar victim sold as distressed property because it was moving downhill.
Between 1996 and 1998 the homes on either side of Peters & Freedman's victim's home were sold by the bank (the City of San Clemente yellow tagged this home) and the owner, respectively for $200,000.
Some of the homeowners in Palacio del Mar with similallrly damaged homes have been caulking over cracks, repouring driveways, stuccoing and wallpapering cracked walls and selling the homes to new buyers without disclosure.
Raymond Kunkle, the long time president of Palacio del Mar at his deposition said he and the board demanded that the new owner of the victim's home cover up the cracks that were visible from the street, Ave del Verdor.
One home that an owner, a builder investor, sold as distressed property for $197,000, in the 90's was put on the market last year for $1,200,000.
The homeowners leave it to the realtors to make any disclosures and the realtors leave to buyers to get evaluations by local engineers.
Peters & Freedman ssued the new owners of the victim's home and in their settlement with them , required the new owners to indemnify the Palacio del Mar Homeowners Association, Peters & Freedman, the board members, the insurance company and the City of San Clemente for any liability of the common area slope behind their home. The City of San Clement engineers wrote a report for the City stating that the slope was unstable and watering should be curbed.
Hess in his deposition stated that he valued the house in an undamaged condition. Overstating the value of this home is misleading testimony from Mr. Hess and helps Peters & Freedman make a case that the homeowner victim undersold the house.
