I sat on the Board of Directors and personally caught Tom Gatlin "conspiring with our Property Manager" in December, 2004 and when I told him perhaps I should report it to Jon Epsten he shut up and became Mr. Legal all of a sudden - refusing to answer questions I would ask him regarding our CC&Rs - deferring the matter to a "Board Decision".
Tom Gatlin have been caught red-handed giiving legal advice that goes against individual homeowner interests in favor of "association" interests or MONEY.

The management firm was Walter's Management, with a sudden shift to Hudson Management of San Diego.

We are in the same situation,
We have not removed much from our website but were instructed to change some things to avoid another lawsuit.
Our HOA has spent over$10,000 of the associations money in actions against us. Our site still stands at www.harrissonsgarrison.com.

My association's BOD got their feelings hurt when we put up a very mildly critical website about the community.
Within 2 weeks of the site going up, we got a letter from Kieran Purcell at Epsten, threatening legal action - though he objected to our posting that info on the front page to our website after we took down the bulk of the site to review it. He has so far ignored our requests for justification of his allegations.
Basically, our board didn't like what we wrote and spent the association's money to threaten us with a groundless lawsuit. It's nowhere near as bad as what other people have endured, but it's worth noting when a BOD threatens first amendment rights.

This nonsense by Epsten,Grinell is an outrage! I know of a friend in an association who hired this law firm and since they have been aboard they have seen many foreclosures .
These attorney's only care about M O N E Y ! HOMEOWNERS MONEY! Too bad that board is too stupid to recognize them for what they really are! Of course,it's been said, like attracts like.
On several occassions they have been caught in misrepresentations, Who wants to pursue the issue in court, after all they'll only prolong any petition and stall to get MORE MONEY.
Of course anyone associated with CAI well.....you know the rest.

She is 75 years old and she invested in a rental unit in Rancho San Clemente Community Association. The escrow closed one and half years ago. She received maintenance bills from two sources Vista Pacifica HOA $163.90/month and AMMCOR Maintenence $15/qrtly. She paid her bills regularly.
On January 22, 2003 she received a letter from Assessment Recovery Department - Epsten & Grinnel informing her that her home would be sold on February 5, 2003 "as a result of non-payment of your assessment account for Rancho San Clemente Community Association. All previous collection efforts have failed. Our office has been sending notice to you at the unit address....".
She had not receive any bills from Rancho San Clemente Community Association. in the year and a half she owned the property and did not know they were due $69/quarter.
She says that Curtis Management, the management company knows that this is her rental property and made no attempt to redirect her mail to the proper address.
The lawyers, board, and management refused to provide copies of all bills and communications, lien or foreclosure filings.
Epstein & Grinnel from demanded $3135.00
Dues owed: $405.60
Lawyers fees and costs $2867.40
