I am an attorney who has been collecting assessments for associations for years. Unlike many of my fellow attorneys I use judicial foreclosure. I beleive it is a safer process for the association and has many safeguards built in that protect the homeowner.
There is a redemption period after the sale so distressed property dealers rarely show up.
In 33 years I can only think of two or three occassions where the property went to final sale. Judges set the fees.
If you check out all the many horror stories you will see that it was the use of the power of private sale that was the initiating event. That should be the focus of legislation to correct the problem and the inequities that result.

This is alot of foreclosures per month by one lawyer. This article was written in 1991 and the foreclosure industry is now worth trillions to lawyers, politicians, government, brokers, managers etc.
.No wonder all lobbyists are spending millions on politicians and propaganda to keep the foreclosure racket going!!

Homeowners report that the average lien and foreclosure fees in Southern California is about $2,500 to $3,000.
Filing liens on homes is big business for homeowner association lawyers.
A foreclosure lawyer filing 250 foreclosures a month makes $625,000 - $750,000 a month for filing lien papers in the County recorder office.
Foreclosure filings are available on the internet for many counties and checking the lawyers name or other business names they use should give you information on how much these homeowner association lawyers are pocketing from your equity.
Homeowners can protect their home equity from lawyers
• by removing homeowner association lawyers from the homeowner association payroll
• by getting laws passed to put caps in lawyers fees

Judgements on credit reports, do hurt homeowners. It's not a guarantee for collection, but it does prevent them from getting new loans, refinancing, buying cars etc.
I think that should be the only remedy available to Homeowner Association for unpaid dues.
