I applaud you for your bravery, as it takes just that to sue an Homeowner Association, as I am finding out.
Could you please post the results of your case against "Desert Crest Community Association, et al".....as I am attempting to reaseach the outcomes of numerous lawsuits such as yours in preparation for my own.

This case is VERY IMPORTANT as it involves ELDER ABUSE, and is very well written. We could all use portions of it in our own complaints.
Thanks to Dave Barela for writing it and taking it on. Without pro-homeowner lawyers and activist homeowners that we find on this website, nothing would change. Many thanks to ahrc.com for this wonderful resource!

I understand completely how you feel; the attorney I retained and paid was apparently "working for the other side!" He was very "secretive" as well, and wanted me to "oust the board, become president, and put him in as the association's legal representative."
When I explained that all we needed was painting, mowing and small claims court for unpaid dues, and that there was NO NEED to pay $12,000.00 a year + "any extras" to a lawyer, he stopped working on my case and when I was ultimately sued by the association (later it was dropped), he said "I got what I deserved."
The North Carolina State Bar said I was to fill out BOTH COMPLAINT FORMS against this man. I have yet to do so, but am "getting myself ready," along with writing my lawsuit. These self-serving and slick lawyers need to be reported as well.

My sympathy goes to the stressful way of life living in a common interest development can be, when those that agree to the covenants then violate them with the boards grasp for power and the managers lack of responsibility to business ethics and lack of understanding of feelings of neighbors living with neighbors trying to protect values so important for the good of all .
My small H.O.A. is filled with what you describe VIOLATIONS and the attorney I have retained is being secret more interested in money than justice.
