The word "JUSTICE" does not seem to be a part of our justice system at all anymore. When will "our government" wake up and start protecting our rights, our homes and our freedom? It seems that protection is only there when tragedy happens.
The government does not believe in prevention what so ever. There are so many issues in this country that "could of " been prevented if only certain agencies would of listened to the people to begin with. I doubt that they are all hard of hearing. It is a simple way of dealing with things they ignore and ignore or they pass the buck to someone else and then issues still get ignored. The politicians say the right things to get into office and then that is the end of the communication lines.
Everyone in this country who is part of a HOA and who are being treated by the board of directors selective enforcements need to go to their States Capital with signs and more signs stating that "WE NEED PROTECTION FROM ABUSIVE, POWER HUNGRY BOARD MEMBERS AND THE BOTTOM FEEDER ATTORNEY'S WHO REPRESENT THEM"

Civil justice is for the wealty, powerful, famous and influential only. Taxes are for the rest of us. The best thing to do is for all readers to write your representatives and senators in Washington D.C. and to keep writing them.
Our Federal Constitutional rights are being taken from us by our State goverments enacting laws that provide a venue for lobbying lawyers, management and insurance companies in order to steal peoples property rights--thus circumventing the US constitution.
This is why RICO (a Federal Law) is being used to prosecute these crooks who steal peoples houses. The time for seeking civil justice is past. It is now time to seek criminal prosecution against HOA Board members, their lawyers and supporting corporate and legislative house-raiding stooges under Federal laws. Like Enron, institutional crimes persist at the local level because of people being paid off to promote a scam until it becomes so large that the Feds must get involved. Then the scam is no longer profitable for the big interests.
At the local level however, hopefully some of the Board members and their lawyers will then go to prison. When this starts happening, then and only then will these abuses end. Have you noticed that ever since the Enron/Worldcom/Tyco scams have gone to the Federal level that CEOs around the country are finally under scrutiny for their ridiculous compensation packages? The Texas Attorney General, Greg Abbott told Mr. Taylor whose home was stolen, where to find a law that gives protection to property owners.
This law was grudingly passed by the Texas politicians after the media and public uproar over widow Mrs. Bleven's stolen home.
The politicans and judges who are on the bribe lists of CAI lawyers , get on committees and commissions and make sure that the bribes keep flowing unhampered by regulations and law enforcement.
Lately, most government and corporate offices have become advertising agents for the lawsuit industry. The lawyers should be charged when civil servants use the public's time and resources to advertise for lawyers. e.g.

Texas citizens should also examine the secretary of state's site where "campaign contributions" are listed. They should see to whom they are given, and then watch what laws are passed or blocked by these politicians in return.
Citizens should then give pink slips to those politicians who are using these "campaign contributions" as bribes. Then there will be some pain in the campaign.

All homeowners in HOA's should be informed of these changes in the law by the HOA Board or their Management Company. They bet on us not knowing the law and take every advantage of it.
As in this case, too often and too late, we find out about something that will protect us from foreclosure. I fight the Board in my HOA constantly telling them they can't do something the Management Company says they can do.
The farce is, the Management Company knows they can't but tells the the board that the homeowners don't have a clue.
Guess what? Some of us do.

Thank you for contacting the Office of the Attorney General.
The administrative policies and procedures of property owners' associations are not subject to review by this office. However, the newly enacted Texas Residential Property Owners Protection Act (SB 507), gives homeowners certain rights and protections when dealing with property owners' associations. This law took effect January 1, 2002.
Under this law, a property owners' association may not foreclose on a lien when the debt owed consists solely of fines assessed by the association or attorneys fees associated with those fines. The association must give written notice before suspending a homeowner's right to use common areas, assessing charges for property damage, or assessing a fine for violation of association rules. In most circumstances, the owner has the right to request a hearing on the matter, and must be given a reasonable amount of time to fix the violation. If an association forecloses on a property and sells it at auction, the former owner has 180 days to reclaim the property by repaying outstanding debts, fines, and costs. After an auction sale, the property may not be resold until the 180-day period has expired.

Dear Mr. Mark Taylor,
We are outraged to hear about what has happened to you in Texas.
While the "Lone Star" State portrays itself to be one of the great patriotic states of this country - at the same time - it promotes communism in the form of HOA housing regimes. Go figure.
While your story is as painful as they come - if it is any comfort - you are not alone in your plight. There are many others across the country who have fallen victim to the HOA regime.
As homeowner advocates we work very hard to spread the word and educate the housing consumers. It may or may not help you save your home, but there is something very cathartic about getting actively involved and knowing you may have saved even ONE homeowner from being villainized and victimized by an HOA board of neighbors.
Homeowner advocates have created informational flyers about the HOA concept in general and leave them on mall benches, in the libraries, at the gas stations, in the bathroom stalls, in shopping carts, at the book stores, on neighborhood bulletin boards, etc..... We are working hard to expose the racket of "foreclosure by neighbor" and other hazards and liabilites of HOA living.
An 8 1/2 x 11 ream of paper and a couple of bucks at the copy center to create a flyer is quite an effective and inexpensive communicating tool for exposing what has been referred to as the 'legalized housing scam'.

I am very sorry about your suffering.
I agree that HOAs have far too much power--so much so that I would like to see these organizations permanently banned by the federal government.
I live in Nevada, where there are laws regulating HOAs as in Texas. But the issue of enforcement remains the same--if an HOA board chooses to break the laws of the State, who takes the Board to task--no one. There are no consequences for Board violations of the rights of homeowners in HOAs, and it does not matter what the laws say, if there is no consequence for breaking them, there is no reason to obey them.
Something must be done and the lawbreakers should be behind bars. Only when this starts to happen will justice be served.

Mark,
I'm appalled to no end after reading your letter. It is my hope there will be 'RETRIBUTION TO ALL THOSE' involved who have done this horrible atrocity to you and your family. I know it's caused you to suffer extreme duress; being caught up in this NASTY WEB of 'THE FORECLOSURE RACKET'. There just has to be a way to stop the terriorizing by many rogue boards, attorneys and judges. Laws definately need to be changed.
There's not enough words to express my concern and sorrow for what has happened to you and your family.

This case demands, as many other cases demand also, that non-judicial foreclosures be banned from homeowner associations. Until that day comes, there will be foreclosure after foreclosure, crime after crime.
Please sign the petition to ban foreclosures before the knock comes on your door.
