5. Lake DonPedro Board and the County and California State Governemnt are gouging taxes from association homeowners  
  Its Saturday morning and instead of enjoying my day, I have to go door to door with a petition, because on Tuesday morning 8/10/04 at Tuolumne county boards of supervisors the fate of our assessment will be decided thanks to Lake DonPedros board of dictators.

I have been trying for years to get our association to maintain the roads in my unit which for some reason were never accepted into county maintenance.

In our bylaws it states clearly that the association shall maintain all streets in the subdivision not maintained by government. The association has never spent a penny on them.

Somehow recently our board of dictators voted to petition the county to put an assessment on all the propertiss in that unit ranging from $200 to $1,200 per year for 15 years, and you can double that if you own 2 lots, to bring the roads into the county service area.

Work will not be started until funds have reached enough to start the project, which could be years down the road. One of my neighbors owns 2 lots, one of which he bought to keep his horses. The fee on that will be $1,100 per year. There is not that amount in grass on 5 acres, plus that same amount will be assessed on his home lot. $2,200 per year just in road assessments.

I have more than one neighbor in that same situation. Mine is a mere $933 per year. This is a modest area with a lot of modular homes

You won't even be able to sell them with that type of property tax on them.

What I do not understand is, where are the brains of our board of dictators and the county board of dictators? They have to realize the hardship this will create. They just must not give a damn, or are just plain stupid.

I blame the county mostly because how did they let this subdivision happen without thinking about road maintenance, and then the association has known about this problem for years and instead of trying to make the county do something, they are trying to stick it on the homeowners along with an illegal raise in dues, bylaw changes, hiring of a managment firm which I'm sure their attorney is the one who got this assessment started.

The sad thing is all you can do is pay, or give up your land because California State government could care less also.

4. I had no idea how rotten, cruel and corrupt people when given a free reign in HOAs  
  Thank you for your very interesting and inspiring story. I grew up on Lackland Air Force Base, and our swim team went to the National AAU championships there. I attended Our Lady of the Lake High School and the grade school, St. Martin's Hall, and have very fond memories of taking art classes and all the rest on the air base. My father was a non-commissioned officer, and I had no idea that it was YOU who helped make a change in status that I later on enjoyed. I had no idea that any changes HAD been made, or NEEDED to be made.

Will wonders never cease? All the more reason for us to "not give up the fight" and make sure that somehow, someway, the laws are changed in regards to HOA's.

We sold too at a loss (given the investment I had already made), even though we got the going market rate, and I can't tell you how happy I am to literally "have my life back."

I had no idea how rotten, cruel and corrupt people can be, especially when given a free reign as they have in HOA's. I never saw that side of human nature before, and hope that until the day I do, I never will again. Never will I be in the position of having my "neighbors" make any decisions for me. It's bad enough with the politicians and president we now have; at least let me live in peace in my own little corner of the world, even if that corner is just my own little "home."

Never again will I darken the doorway of any HOA, as "abandon all hope all ye who enter here!" I know that many places are practically all HOA's, but I chose a lower-cost place in a lower-cost neighborhood where there definitely is no HOA and never will be (no one is interested here, as there isn't enough money to go after!). It's funny, though, as we truly have a certain amount of peace here. There's a couple of mean and nasty neighbors, and all I can think of is "thank God they have no power over me, or anyone else" ... I could just see them sending fines and raising dues and really going to town with the devil that they already are.

3. Every victim invited theft by being too lazy  
  The Declaration of Independence clearly stated, "All men are created equal"...but history shows us no nation or generation escapes greed or lust for power. Contrary to sales ads, common interest developments aka quasi-government were designed for one reason only. To trick the public into accepting Quasi-government controls to tax,control population without charges of discrimination, and profit from foreclsoure through a little known restricted deed sold as CC&Rs, covenants, conditions and restrictions, little known and rarely understood.

The National Home Builders Association, Urban Land Institute and Management firms think tank startedoff by fooling the Congress into thinking this social experiment in housing made better use of land and offered each community more recreation at less expense without revealing these contracts violate the Unfair Business Practice Act( Sherman Act) and 'Truth in Lending (FTC) etc. because each is misrepresented, none make full disclosure, all of them are guilty of "breach of contract, " and even though each is sold as a 501(c) nonprofit corporation, under a secretary of state, the greedy developers and agents pass them off as a "volunteer board elected to provide residents an opportunity to livein hamrony, without one single copy of the state 501(c)nonprofit corporation law or where buyers can obtain a copy.

No one drives a car without a license and no one is supposed to own or operate a nonprofit corporation without complying with the statutes that outline the fiduciary duty of directors etc.

Although it is a state duty to police nonprofit corporations and assure they comply with all statutes, not one state has closed any violator down because all city and county commisioners value the profit of double taxation service-free groups, so much- no politician will risk loss of office by eliminating or fining a cash cow.

HOA homeowners have fallen into the hands of CAI lawyers' and managers' foreclosure traps because state governments not only violate corporation laws, they also violate homestead protection when they let a sheriff levy a judgment lien on a home exempt under homestead rights, because trial lawyers and judges intimidate them.

California was the first state to file a racketeering under RICO against a CAI HOA Manager firm, and all 50 states are aware this racketeering spread since 1973 has reached greater profit making proportions than the early mafia Hoover fought in the twenties.

Under nonprofit corp law, directors cannot be unreasonable or make arbitrary decisions but few members read the 501(c) 3 statutes or consult their elected senators and representatives to get help one enforcement in spite of the fact our current legistlatues are so overpaid they live like a Saudi Prince.

In the past forty years I attended monthly meetings in every city and county commission meeting open to the public( in different states) and found the average meeting room large enough for more than one hundred people, but never saw more than two rows of seats filled, I also noticed each board allows public citizens five minutes to address their complaint and the average TV commercial is three minutes long so a citizen can deliver strong complaints if they prepare it right.

On TV talk shows I used to hand print key words in bold print one inch high on a 3 by 5 card out of sight to trigger my memory for call in shows, to eliminate boring viewers by reading.

Letters to the editors are a great weapon to fight crime like property theft but less than one in a hundred write editors.

Call in TV shows offer toll free phones for feedback and web sites like, rippoffreport.com, badbusinessbureau,com, are doing great public service by advertising rippoffs free of charge nationwide on the web.

Governor Gray Davis was recalled by petition and every citizen has the right to petition the government for redress so why are so few petititions filed when the internet will give you free copies of simple forms to print out.

New Jersey ruled all maintenance fees are a tax, no matter what your homeowner assocation tells you and any board that hands out all it's maintenance and reserve funds to law firms for vendetta's are guilty of misusing funds. That is violation of public trust and the 501c nonprofits which are making huge profits from stealing homes liened for excessive legal fees that also violate the "reasonable business man rule" to make so many millions in profit, one CAI lawyer, "Miller" donated some of his HOA property theft profit for President Bill Clinton to build his Arkansas Library...

Don't forget Clinton pardoned his millionaire buddy, Marc Rich for 250 million to get a kickback so why didn't every one of the 55 million CID homeowners demand congress givem tax amnesty and forgive all liens udner the "equal protection" clause?

As a child my grandmother taught me, "If you see a wrong and don't try to right it you become part of that wrong." The double taxation without representation(lawyers don't count) and the billion dollar profits from CAI foreclosure law firms fall in the same wrongs as racketeering J. Edgar Hoover sentenced Al Capone for.

Al Capone had retired in the tiny town of Lake Placid,Florida quite secure they could not convict him on crime so they got him on tax evasion...why does the IRS overlook the giant profits of the HOA lien and foreclosur rackets.

One Orange County, California lawyer boasted of his monthly foreclosures many years from his partnership with the management firm.

From the day CAI began it's nationwide monopoly of HOA lawyers and managers, these partnerships surveyed every resident's record to prey on the meek, the weak and the uninformed.

The truth is every victim invited theft by being too lazy to reseacrh state nonprofit 5019c) statutes, to speak out in city and county meetings, to file public trust violations against any official guilty of aiding or abetting and making sure each State Bar Association received lien and foreclosure documents to show these lawyers violate the code of ethics and Sherman Act?

When World War One ended, many low income, disabled Vets became angry when congress delayed promised help. The poorest of the poor loaded wagons, model T fords and camped out in Washington, DC. by the Captitol to protect this breach of promise by the Dept of Defense, Veterans and Congress.

They didn't have money for hotel rooms and the camp out was far from comfortable but their actions won a hearing with help
when the news ran illustrated stories. Today you have many networks and web sites to put the spotlight on every action.

Take a few minutes to print out one sentence, "If it's going to be, it's up to me, " and post this on your bathroom mirror and over your desk etc until it is engraved in your brain, then go into action.

Franklin D. Roosevelt told us, "There is nothing to fear but fear itself, " so drag out the Bill of Rights and memorize the words on due process along with equal protection...demand a copy of the job desciption for your state attorney general and underline the part on enforcing civil rights and don't take no for an answer.

I have challenged every law in the land from 1944 from the lowest office to the highest at the White House with nothing to fear even though I was a military wife when I took upmy first fight against housing discrimination of enlisted men.

President Lyndon B. Johnson informed Lackland Air Force Base, Texas, they could not discriminate against my family in housing or club benefits because my husband , M/Sgt Rudy L. Vance was a non-comissioned officer. You will never know the joy of my White House Call and later letters signed by him in 1955 coming to my rescue because I dared to hold my president accountable for his constitutional oath when my family was denied equal protection.

I often felt my letter brought results because I asked President Johnson, "How would you feel as a father if your daughers Lynda Bird and Lucy were treated like such second class citizens they could not attend a good school, enjoy club benefits on their dad's Air Force Base, or even enjoy simple art lessons paid for by tax dollars?"

His personal letter informed me he was touched by thinking of his daughters in the position of my two children. So take it from an old 76 year old World War Two Military widow, the best thing you have going for you is remind the official you write, all you ask for is the same equal protection he or she has.

Then remember Thomas Jefferson warns us when this republic they gave us no longer works it is our DUTY to reform it and my fellow citizens it is clear our Bill of Rights promised us property rights destroyed by common interest developments and theywill not be restored until we convince state and federal legislators to dissolve all CID and ban the sale for a violation of public trust and failure to enforce laws on a nondiscriminatory
basis to remove the criminality.

When you hit them in the pocketbook the abuse will stop because money talks. America, the beautiful has become America the homeless, and I do not live in a CID because I sold at a loss rather than support an unconstitutional form of government that threatens to destroy every rule of law our Founding Fathers fought for. It is up to us the living to honor the rights given us by those who paid a dear price...MIGHT does not make RIGHT...
