I would be glad to help you in any way that I can. We were served by the Board of Directors of our Association, Montclair del lago estates in Escondido, California October 2003, with the court date in May 2004. What was the reason?
The board wanted us to PAINT our perimeter stucco wall and we wanted it fogcoated. They had caused the "damage" with their sprinklers and we wanted to meet with them to discuss it. The Board through their attorney refused any meetings or any mediation, and denied ADR.
Montclair Association legal fees amounted to somewhere around $10,500 and our legal fees about $9,000. The net result? They "let us" fogcoat our portion of the stucco wall, though they would not meet with us. They lost their fight for legal fee reimbursement so they paid $10,500 to their attorney. We were told by the Judge that we did not countersue and since the association had no legal basis for their lawsuit, we could not be awarded legal fees either.
At the November 2004 Board meeting we specifically asked the Board why they did not follow their own Alternate Dispute Policy which they circulated with the 2005 budget. And why would they never meet with us upon our numerous requests. Their response? Both the Board president and Prescott
Management Company representative stated that they had been given "bad legal advice." Their attorney told them that this case did not require Alternate Dispute Resolution. And the Board told us that if we wanted to discuss this issue "we should have come to a Board meeting to discuss this issue." Even though they filed a lawsuit without any offer for meeting, discussion, or mediation.
They have since "fired" Mary Goodhue Deutsch, their attorney that gave the "bad advice." The net result here is if you are an attorney and the Board you are representing does not have conscience or common sense then as an attorney you can lie, bully and weasel you way into some cash. You can tie up the court system with petty issues and create disharmony in the community. Wow, what a "JOB".
And furthermore our Association is raising monthly maintenance fees by 20% this year. Of course wasting our money on legal fees "was not an issue". This certainly is not quality of life in an HOA as we had envisioned.

I am the victim of dicriminating harrassment by the builder, Elias Brothers Communities, a property management secretary from R&P Property Management, as well as the Ibis Cove Homeowners Association.
I want to partcipate in a documentary film and also have wonderful ideas on how to stop the "camera-people." I live in Naples, Florida. I own a business, ParadisePrivateLabel.com.
My stint as Community Pariah began when I stood up to the smug, rude manager. My only comfort is that I see I am not alone. This message is also my profile.
I have been notified that I must pay a 200. fine for having a "For Sale" sign in one of the windows of my vehicle.
Prior to my "violation" and to date, other residents have had the same signage. I need an attorney. I wish to sue the Homeowners Association and property management for harrassment.
I have pictures and affidavits to substantiate my claims.

Our homeowner association, Fountaingrove 2 east, in Santa Rosa, California., informs us that even if we wanted to change a rule, we couldn't as there are 147 lots/homes as yet un developed, and our governing documents allow the developers 3 votes to each lot, whereas the homeowners have only one vote per lot.
We would need 100% of the homeowners to vote for an amendment, and then we would only be 3 votes ahead of the developers. I have been told that this is the way the developers prevent rule changes and keep control on the homeowners.
Ironically, when the 'Architectural Review Committee' the Fountaingroves 'Open Space Maintenance Association' entity that enforces the rules and overlooks architectural plans collecting fees for doing so etc., wanted to add some rule changes wording of it's own two years ago, it did so with 2/3rd's responding and a greater than 50% vote in favor. Now that homeowners want to amend one of the rules, we are told that the developers get the vote.

Great idea,
I think that members of HOA's need to recognize that media exposure is the best way to deal with the corruption. I am a television producer, and I am persuaded that media exposure works. If members got together and decided to publicly expose some of the things that are going on, it will catch on and get widespread media attention. Only then can we get the politicians to take notice and promote change.

Way to go!!! I had to laugh - we are probably neighbors.
I am SICK and TIRED of the "BULL' that goes on in our Homeowner Association. It ought to be illegal what the Board of Directors get away with. I am all for people standing up for their rights. We need to face the many Homeowner Boards with law suits such as harrassment and discrimination. We should also go after the management companies who enable this type of injustice.
When you make your documentary - please get in touch with me. I would love nothing more than to expose my association.

Interesting concept...
Set against the glamorous, erroneously-presumed affluent setting of Palm Springs-Rancho Mirage-Palm Desert, California "the playground of Presidents" and the land of 'fenced (gated) communities' are many examples of "good gone bad" (aka HOA's literally screwed into the ground by "volunteer" board members, unregulated, indemnified "expert" managers (CAI/CACM/EHCO affiliates of course), and billing-hour-driven attorneys...
All of whom were presumably too busy 'slopping' themselves at the trough rather than "serving" their community and clients...
Look closely when you meet them, or they walk past you at the next board meeting, the driving range at the golf course, or up the aisle at the sunday morning services at your favorite house of worship - adorning their "Circle of Negligence" lapel pin given to them for another year of dutiful commitment to their trade at last year's annual raw-raw BBQ/Pot Luck paid for by your monthly dues...you can't miss them...just look for their mud, weeds and fly covered curly tails which are always sticking out of the top of the seat of their pants or out from under the bottom of their far-too-short skirts...
Notice the look in their eyes...it's always the same...the knowing look of knowledge of their own graft and corruption...
In the distance they hear it...and it worries them, but they try to hide their own fear...the sound of clanging together of pitch forks awaiting them when they pass on to their own 'gated community'...the depths of hell for what they have done to the innocent and unsuspecting residents of HOA's.
Contact us here in California...we have stories for you that will turn your stomache...the same people, over and over and over again...screwing one HOA after another into the ground...with no recourse or accountability...and being paid handsomely to do so.
....and this is the land of the free?
