Everything that was said is correct.. I thought you were talking about our Board here in New orleans.
Now that we have a chance to get our roofs done correctly , the board has fired the second management Co. We got a special assessment 4 years ago to get new roofs, what we got was roofs that leak, that did not leak prior to getting new roofs.
Now since Katrina, the insurance will pay and now they have changed mamagement co, To guesss who.. The President Brother Co...... I wonder what we will get now.
Bootleg roofers while the Board members get the Good roofers? Assessment fees keep going up also.private meetings , eveything you said in the article is my association..

It has gotten worse .....but this article and a few others have inspired many into becoming activists, writers, voters , and businesses and civil servants.
Californians used the initiative process to recall Gray Davis. Among his infamous credits - he authored the homeowner association foreclosure laws for Califiornia almost 20 years ago "to take care of the lobbyists - builders, insurance companies and lawyers".
This recall has given the people hope and instilled some fear in the corrupt, entrenched crowd of lawmakers and their staffers who work for special interests. In April of 2003, Californians watched some 3,000 Gray Davis' staffers scurry about sending out resumes.
There's more cleaning to do in government and corporate offices...including homeowner associations.
The voters have since swept Davis out of office, but there's alot more cleaning to do both in government and corporatate offices, including all the homeowner associations.

I just read this article written almost 10 years ago ... the situation is worse rather than better.
The people who perpetuate this abuse know one thing, the individual owner is busy working and trying to take care of his own business. He may take some time out once in a while to attend an informative meeting, sign a petition or engage in conversation about the inept and even suspected illegal group that governs his association while the perpetrators have plenty of time to pursue their issues, this activity is their work..THEY ARE PAID TO CONDUCT THESE ASSAULTS, THIS IS THEIR FULL TIME JOB.
Only a "million owner march" on our state capitols and Washington,DC will bring about reform and fairness...to political lawmakers it's the numbers that move them, for every marcher they multiply by ten the votes represented.
We can all fight individually till doomsday and the victories will be few and far between, our only clout is banding together for one huge demonstration to demand laws be changed to give individuals equal protection to address wrongs and to stop the litigation as their first line of offense against an individual...this is America where everyone is afforded equal rights under the law.
We must demand balance, where our legal system provides justice instead of harrassment.

Why do you need a lawyer after being on the board? I'm not an attorney, but let me know if I can help.

This article is 100% true.
I managed to finesse my way onto the board and would resist unwarranted or cruel actions against our homeowners. Now I'm the one who needs a lawyer...
I'll fight for my equity even if I have to do it pro se. I'm a good speaker and will try and get a jury trial. I'll also go for as much publicity as I can get.
Lawyers who practice in Washington State, please respond to this thread.

I am in the process of "getting all the information" myself. While I do understand that these people are, generally, doing this without monetary benefit, people volunteer for things because they get SOMETHING out of the volunteer. Our board members are all in violation of the bylaws, and that is okay because no one is "managing" their properties.
It is important to have checks and balances in any organization, especially one that YOU are funding! We all get caught up in letting someone else take care of it, but the question is ARE THEY?

I live in a small gated community of 42 homes. If you recall, there was a 20/20 program on a year ago that spoke to how some of these communities are being run more and more like small dictatorships that border on Hitlertarian type boards, where people are literally losing their "civil rights," and without "due process," and this with knowledge and support of the government.
I have just recently been reading some web sites on the ongoing problems in these gated communities that give me pause to think, and to be very concerned. Most are run with a small board of four or five people [regardless of the size of the community] who are literally small "private governments," who can make rules and regulations that give them almost complete control over the lives of those who live there, and with no legal recourse, e.g., your home can be foreclosed on without any sort of court procedure, and for a unpaid fine of $100., for an infraction of some rule, that grows into a $1000. and before you know it, you have lost your home -- without even going to court.
If you aren't aware of just how these communities are growing, and growing in number than you are in for a big surprise.
Here in my area, Palm Springs, CA about 75% of all housing already is, and most future housing is being planned for, as "gated communities."
However, this is also a growing phenomena in the United States. Unfortunately, the problems are growing and growing in these communities as well, but, instead of the government coming to the aid of the people to help them keep their civil rights, they are assisting these communities in gaining more and more power.
Isn't it time to ask; WHAT is going on, and, what is the real purpose of all these "gated communities" and new laws that violate the very civil rights we fought so hard for in this country???
And, why isn't the government backing "the rights" of the people? I am not a conspiracy person, but... this is just tooooooo strange.
And, now in the states of Washington and Nevada there have been new laws adopted in which the board of directors are given even more "power."(Our board director, in our little HOA of 42 homes is already a little Hitler right now!)
EXAMPLES: Washington State Homeowner Association
Law for Budget And Assessments - RCW 64.38.025 (3)
Law gives absolute power over budgets and assessments
to Boards of Directors -- March 24, 2003 AHRC News Services
Nevada Law For Budgets And Assessments - NRS 116.3103 (3)Law gives absolute power to Boards of Directors
March 24, 2003 AHRC News Services
I believe the government is counting on our apathy as a nation to get away with this?
And, I am about convinced, these ARE the new "internment camps" of the New World Order -- and we all "bought [literally] right into them," and they weren't cheap! We bought our own prison system.
So, what to do about them? I mean really, what can we do ???

And I thought it was all a coincedence.
I tried to sell, my realtor even wrote the property manager a letter about repairs that had to be completed by a neighbor in order to close. I lost the sale on my home and 14 months later, the repairs weren't even started.
When I resorted to suing thy neighbor and requested copies of all these letters the property manager said she sent to the neighbor month after month after month, I learned she never sent any. Between this, her lack of organizational skills, inability or unwillingness to follow through or follow up on anything and pathological lying about everything - I have had it.
Can someone list some good property management companies so I can provide them to my board?
