  Notice that some people have been providing quotes.....so I thought I would add one.............do not know where it came from but I like it!!!!

I think it is very appropriate for those of us who refuse to allow our HOAs to walk all over us. I only wish those who do would realize what they are doing wrong. If more people would speak out against their abusive HOAs it would be easier to convince our legislative representatives that there is a problem!!!

I like your first quote very much: "IF WE ARE FACING IN RIGHT DIRECTION, ALL WE HAVE TO DO IS KEEP WALKING. .....BUDDIST PROVERB." In fact, I like it so much, I'm going to start using it on my posts in my own state of Colorado and other states throughout the U.S. Thanks for posting it! :-)

Here's another quote that I thought was profound and also seemed to hit the nail right on the head re HOA homeowners:
"The limits of tyrants are prescribed by the endurance of those whom they oppress."--Frederick Douglass 1857.
That is, homeowners who live in HOAs will indeed take back their property rights -- Constitutional and statutory -- when the limits to their endurance of being a slave to their HOA boards of directors and CAI lawyers become exhausted.

Yes, we can hope for the best while working as hard as we can to achieve it.

For example, when we find a legislator in our state who is "on the take" from any lobbyist -- especially a member of the Community Associations Institute (CAI) -- DO NOT VOTE FOR for that legislator. Work as hard as you can to REMOVE him or her FROM OFFICE as soon as possible.

7. The State Bar/IRS/FTB/Attorney- General /FBI may on random basis look into the issues of their interest in public interest  
  In response to comment #6, I fully agree with Respected Ms Jan Jackson and in my comments time and again I have been mentioning that for one reason or other , it appears that Our Government ,Federal ,state and Local have in my opinion have overlooked the interests of the Homeowners in CID affordable living. On other hand mortgage/credit/Gas issue/food etc have also resulted in great impact on the society.

Housing mess has not only taken toll on homeowners by loss of equity ,yet also led to loss of revenue/recession/ impact in global market and cash reserves of our treasury and as you may agree that we do not foresee any remedy in near future.

This has been mentioned by large numbers of contributors /writers in these columns but it appears that it did not reach the concerned.

I am of the opinion in order to fix the issues it is high time for the intervention of Government agencies is highly appreciated in the interest of all concerned lest it is too late.

It may be of some interest that IRS conducts as per my understanding 3% audit/tax evasion cases approximately in view of high cost involved but it is their intent that such cases/penalties are imposed and such tax payers are exposed to have an impact on the society and it result in recovery and may reduce reoccurances of tax evasion cases as I feel jurisdiction. However I do not want to enter into any controversy on the subject.

In consideration of the above it is felt that if State Bar/IRS/FTB/Attorney- General /FBI may on random basis look into the issues of their interest in public interest and in their jurisdiction and scope and in case of any findings of interest , it may help to improve the affairs and concerns of Entities in future.
Needless to mention Honorable Lawmakers may also review the subject and ratify/amend the laws accordingly if they feel necessary along with MEDIA who may send the message at every nook and corner across so that re-occurences do not occur.

As stated elsewhere the issues are so complex and remedy appears to be a nightmare , all we can hope for the best.

However I would like to extend from the core of my heart to AHRC.COM and their dedicated staff for their efforts to draw the attention of the concerned time and again and I am sure someday their efforts shall bring fruit to the society.

While I agree with almost all of what you write, one problem remains that We the People must fix, somehow, before the rest of the problems can be addressed.

And that is that "our government" is NOT the solution to the homeowners associations "mess". "Our government" -- local, state and federal -- IS the problem.

So, the real question is, "What do We The People do about our government problem which allows -- rather, ENCOURAGES -- power-and-money seekers to put all of us lowly citizens (not power-and-money seekers) under their fascist boot," eh?

5. ...reforms with due consideration and in the interest of HOMEOWNERS,The Concerned People.  
  I strongly agree with the views of the author. I do not know if you may endorse the call of time to look into corrective tentative steps with due respect for the reforms with due consideration and in the interest of HOMEOWNERS,The Concerned People.

With the mortgage/credit mess Our Governmentt has been trying hard to find ways and means to save the state of affairs, by having interest cuts seven times with rebate checks/housing bill and California state has also suffered in revenues in property taxes.

Moreover Other countries say China are also trying to become self-reliance with reducing exports to other countries creating a gap.

Needless to mention the laws relating to CID affordable living are pro-industry based and do not support the interests of Homeowners in my opionin.

To cite an example California State AB1921 bill rewrite of Davis-Sterling act in short does not cover much reforms as I feel is in progress and in my opionin may be kept on hold please in view of present conditions.

Moreover the existing laws have not been able to address basic issues viz elections,liability insurance, reserves, assessments regular and special, liens etc to name few and no meaningful mandated penalty for associations for non-compliance for one reason or other.

The call of the time is COMPLIANCE AND ENFORCEMENT OF THE STATUES for which humble reference is being made to Honorable lawmakers to have corrective necessary steps in the interest of the Concerned People time and again thru these columns.

As you are aware that several common interest development-related legislations, which do not include MEANINGFUL and EASILY ENFORCEABLE penalties against erring boards; fines and criminal liability , financial Code statutes to prohibit any association from allowing or waiving association bank accounts and assets of Homeowner as bad debts if any needs to be considered accordingly.

It is in my opinion needs to be regulated by State agency in letter and spirits as the concerned have failed to impose themselves self-discipline , in case such cases occur, these may be dealt severely in public interest if any.

In the absence of no cost-effective way for the affected owner to enforce a penalty against the concerned that acts unlawfully if any with the protection against liability insurance shield.

And in view of so many complexities and restrictions in CID living, the very purpose of such living has been lost. For the growth of state and economy, CID living plays an important role as it has great impact on the State infrastructure and cannot be ignored as I feel.

This also places automatic contingency on the purchase and sales directly or indirectly with extra financial burden in present real estate market and may have impact of deal for one reason or other. I also feel it also has impact on the growth and economy of the state.

Under the circumstances, it is strongly felt that if deem fit corrective steps/concerns/proposals may be suggested at the earliest to ratify the existing laws for COMPLIANCE AND ENFORCEMENT of such laws with mandated penalties if needed along with state regulating agency such as state bar/FCC/FTC/Attorney General office with extra powers etc to be read in context to The Honorable Lawmakers or may deal in the manner deem fit.

Based upon present state of affairs and as it is the matter of deep concern it appears that we are at the point of no return with no remedial results as I feel in view of complex nature of the issues.

Lastly it is humbly submitted respectfully to all concerned that it is not intent to critize or to point out failures on the subject but it is felt the subject may be reviewed in the best interest of all concerned lest it is too late and has no refernce to the litigation in any way and are my personal views only.

So, to rid ourselves of HOAs, we first must rid ourselves of state legislators who are "on the take." That is, who don't mind taking "perks" from the HOA Industry -- in whatever form those "perks" might be in when they arrive at our legislators' back door.

3. GET RID OF HOAs -- in Colorado and every other state in these United States!!!!  
  To the writers of Nos. 1 & 2 comments:

Agreed. Problem is, when we try to get anything productive and constructive done about HOAs, we meet a stone wall of silence that is too high for us little taxpaying people to scale from the local and state authorities that could, if they would, do something about it.

Why? Because they themselves created this HOA mess in the first place. And it's looking more and more like they KNEW WHAT WOULD HAPPEN when they created it. (sigh)

HOAs serve one purpose, and one purpose only: To allow our city and state governments to keep more of our hard-earned money.

How do they do that? They mandate, under the law, that no new housing developments will be build unless they have a homeowners association attached to it (often along with a common interest community). That means that the homeowners who buy into them pay not only pay extra for the services for their own community (because HOA housing falls under a private contract), but they ALSO pay the same city and county taxes that non-HOA homeowners pay. Money that would, under normal non-HOA circumstances, be taken from our property taxes to pay for those services.

It's called "double taxation" and it's a pocket-filler of free cash for city and state governments to do with whatever they want -- usually it's used for their own money-making pet projects that they all have, or just put in their individual, personal pockets.

What's the fix for that homeowner problem. GET RID OF HOAs -- in Colorado and every other state in these United States!!!!

Rectifying those forced into foreclosure and being made homeless NEEDS to be a priority in this country, not a choice. In addition, the national media NEEDS to start doing their job and tell the truth about the victims and this industry! There is a paper in this Commonwealth, that has a writer who has attempted to get some of the truth out. This is just a start. This writer needs to be given the go ahead to expose

EVERYTHING he knows and get his peers across the country to do the same! I believe the writers name is David Pierce and the links to some of his investigative reporting are:
