Regarding comment #6, I believe that the following link will answer the question posed "where is the LA TIMES" Real Estate Section editor: http://www.latimes.com/news/local/valley/la-re-hoafraud6apr06,1,938502.story
(from the April 8 2008 edition)By Frank Nelson, Special to The Times April 6, 2008, in the San Fernando Valley Edition.
I believe this story does justice to the subject of HOA Fraud, and it does mention kickbacks from vendors (commonly known as "graft" ) or 'corollary embezzlement' as it might be known. I would add that the means of the kickbacks may even be indirect an obscure, being collected from other vendors of different services, to thwart detection, given the internet and spreadsheets!
When I asked corporate counsel why the legislative update did not include information on criminal statutes [applicable to] wrongful acts by BOD members, he said that the only thing that BOD could be prosecuted for was stealing!
Well, counselor(s)....!

Wonder how much cost they are causing other HOA's to incur for lawyering? You kind of have to wonder if some of these HOA industry lawyers tend to foster dissent among the ranks because after all, dissent means more money for them right? Absolutely right!...something to think about. Wonder no more! Read any legal brief of any CAI lawyer and you will very quickly see what they're all about, i.e., power and money.

To writer of Comment #6:
You asked, WHERE IS THE LA TIMES REAL ESTATE EDITORS? They have an excellent HOA housing Q and A section and you would think they would be scrambling to get this out in their real estate news. Did you forget that realtors are part of the power-and-money-seeking HOA industry????? Methinks they probably want AHRC to go out of business as badly as the CAI lawyers-lobbyists do.

Hope these lawyers go out of business soon.
If I were a member of any HOA with such HOA industry lawyers at the helm, I'd be very worried and would try to get them fired! Wonder how much cost they are causing other HOA's to incur for lawyering? You kind of have to wonder if some of these HOA industry lawyers tend to foster dissent among the ranks because after all, dissent means more money for them right? Hmmmmm.....something to think about.

You make a good point Shirl - with something like this being such HUGE news in terms of freedoms - WHERE IS THE LA TIMES REAL ESTATE EDITORS? They have an excellent HOA housing Q and A section and you would think they would be scrambling to get this out in their real estate news.
What is it? Why won't they cover this? Competition? Fear? Political? Seriously - LA TIMES REAL ESTATE EDITORS - WHERE ARE YOU????? Strangely silent, eh??

I'm appalled to hear of this threat to shut down AHRC. This isn't communist Russia! I heard someplace "cockroaches hate the light"!
You've definitely hit a nerve. Those who are trying to threaten this absurd act are (to my understanding) beyond unprofessional.
What about the real estate section in the LA Times. Articles on HOA's are constantly published, are these lack of common sense unprofessionals going to try and stop them? I think AHRC is thousands of miles ahead of these jackal's.
I will keep you in my thoughts and prayers.
Sincerely.
Shirl

unfortunately i believe that in today's court system, it's not always about right or wrong, or about following the letter of the law. all too often it is about the whim of a judge, a retired judge, who might be accountable to no one, but who may be beholden to someone. at times there seems to be no rhyme or reason as to how a case is ruled. having been through it, i have little respect for our so called 'justice' system. it's a sham, er....a shame.

It doesn't appear that there needs to be grounds for anything in this world any longer. What our world has appeared to become is who has the deepest pockets to destroy whoever they can destroy.

Jan: I am not sure I understand on what grounds any party would be legally allowed to shut down the AHRC Web site.
I read your post and also the earlier post about this. I still do not understand. The first thing that comes to mind is free speech. As long as what you say is true, there should be no problem. Please explain.
I am happy to help in any way possible.

It is expressed with deep sense of gratitude to AHRC dedicated diligent staff for helping affected homeowners to send their message across from time to time and an humble appeal to concerned to review the subject in the best of all concerned in the present state of affairs.
It is also hoped that we may learn from the mistakes and past experiences from Homeowners as read in these columns /credit /mortgage mes/Inflation/recessions etc to name a few. Moreover it is call of time to make all out efforts to have peace and harmony and enviroment and other issues all over the world which have been disturbed for one reason or other and may resolve differences if any.
It is also time to restore confidence, creditability, faith in the communities in my opinion to be read in letter and spirits as of the people, by the people and for the people in the interest of all concerned for the time to come if any.
I strongly feel truth will prevail sooner or later in the affairs and concerns of communities if any someday and moreover well known saying as "pen is mightier than the sword"
In view of the above I am sure the concerned if any may endeavour their best to resolve the issues amicably if deem fit and may reviesw the subject once again.
With kindest regards,
