Summary: Recalling an elected official is not something that should be done lightly, because it is overturning a prior vote by the citizens. However, there is no question that Gray Davis should be recalled. There are many reasons for this, but AHRC will focus on 2 related reasons here.
First, Davis has sold out the public interest on a scale unprecedented in American politics. He gathered an unprecented $97 million dollars for the last election - all from special interests in exchange for favors that he granted to them. This fact alone is sufficient reason to recall him.
Second, Davis has been the cause of many homeowners losing their homes in foreclosure, and many homeowners losing millions of dollars to preserve their homes.
In 1985, Davis authored as an assemblyman the Davis Stirling Act. This act authorized the taking of homes in homeowner associations for minuscle amounts of money of disputed fees. It mandated attorney fees to CAI collection lawyers. All this was done to "take care" of these CAI collection lawyers. The CAI lawyer who actually drafted the bill admitted this at a public meeting.
In effect, because other states followed suit, Davis is the architect of the national foreclosure flood that has swept the nation. He made homeowner associations into detention camps. He stripped the American home of its traditional freedoms, creating Guantanamo Bays, where citizens are stripped of all rights.
In the process, he created a fabulously wealthy class of builders, lawyers and other sychophants who feast off the American citizen.
When a governor is willing to sell citizens' homes and rights for campaign bribes, it is time for that governor to go. Now is that time. Support the initiative, and take back our homes and rights.
The following are excerpts published by various groups seeking to recall Gray Davis, the governor of California.
The goal of the Recall Gray Davis Committee is to recall Governor Davis and remove him from office. This is a broad-based coalition encompassing many political parties and ideologies, and they are not advocating any individual candidate to replace Gray Davis. Any of the prospective candidates would do a better job as Governor than Gray Davis has demonstrated.
To get the recall effort on the ballot, over 1.2 million signatures of registered voters in California must be collected.
Gray Davis won re-election after he misled and deceived the California voters. He covered up the true seriousness of the budget deficit facing California in order to avoid defeat at the polls.
California has the largest budget deficit in any state in the nation's history - $34.6 billion. Davis' plan to fix this is to tax the Internet and to raise taxes on income and businesses.
You can take action NOW. Tell Gray Davis and all politicians that there are consequences to their deception and fiscal recklessness.

Californians will likely be asked to first vote on whether or not to recall Davis, then to select a new governor. Although no Democrats are running for the office, several Republicans and Green Party candidate Peter Camejo have already announced their intention to seek the office. Why are you attempting a recall of the governor so soon after his reelection last November?
Our reasons are outlined in the notice of recall but the bottom line is that the Governor once again lied to the people of California about his failed leadership on the budget crisis. After costing Californians billions of dollars through his inaction in the early days of the energy crisis Governor Davis has now turned a record state budget surplus into a massive $34 BILLION deficit in less than two years.
When the state budget was passed last year after a record delay on September 8th, Governor Davis assured us that he had the budget crisis under control and then attacked anyone, included his opponents in the November election who tried to "scare" people with the talk of massive budget deficits. After spending over $70 million collected from special interests to get narrowly reelected on November 4th, the Governor announced a record $34 BILLION deficit shortly thereafter. By early January Governor Davis was advocating BILLIONS of dollars of new taxes that will break the back of the California economy.
Conclusion: This is a classic case of misfeasance and cover-up that robbed the people of necessary information—information possessed by this Governor and his agents, but withheld until after the election.
But is it legal to do a recall so soon after the election?
Absolutely! The power of recall is a Constitutional Right of the voters of California that was placed in the Constitution by Governor Hiram Johnson along with the powers of referendums and initiatives. The recall is the legal means for voters to fix mistakes that are made at the polls and the reelection of Governor Gray Davis was the biggest mistake in California history.
Is there an "official" recall organization?
Yes! While many organizations will be helping to collect signatures on the recall petitions, the Davis Recall.committee is the organization that has filed the official recall and will be responsible for turning in the collected signatures to the various County Elections Offices around the state. The Davis Recall.committee is a special project of People's Advocate Inc.
People's Advocate is a California non-profit 501(c)(4) corporation. Its mission is to be a government watchdog on matters of taxation, government spending and other issues of importance to the public. It was created by the late Paul Gann of Jarvis/Gann fame. People's Advocate has 47,000 members and 390,000 associate members on its mailing list within California. In the last 20 years People's Advocate has qualified 12 statewide initiatives for the ballot; and People's Advocate has never failed to qualify a measure it sponsored. People's Advocate keeps all recall funds in a separate bank account and accounts for all expenditures to the Secretary of State. All filing will be under Davis Recall.committee, FPPC #1253300.
How does the recall process work?
The first step is for at least 65 registered voters to serve the Governor with a notice of intent to recall stating their reasons. This important step was done on February 5th here in Sacramento by a dedicated group of California patriots who journeyed from near and far to the People's Advocate offices in the early morning hours. The Governor had seven days to file an official response to the recall which he did on February 12th. The Davis Recall.committee then published both of these in the Sacramento Bee as required by law and asked the Secretary of State to certify the petition of recall for circulation.
From the date of certification, as the proponents we have 160 days to collect 897,156 signatures from registered voters on the petitions, which is 12% of those voting in the last election for governor.
What happens when enough signatures are collected?
The Secretary of State will update how many valid signatures have been collected on at least a monthly basis. If the required 897,156 valid signatures are collected, then the Lt. Governor will be required to call a special recall election within 60 to 80 days of the date of certification.
The recall election ballot will have two simple questions. Question one will ask should Governor Gray Davis be recalled, answered with a simple yes or no? The second question will ask whom they would vote for as the next governor of California in the event that Governor Davis is recalled. There will be no primaries or runoffs in a recall election. If Governor Davis is recalled in question number one, then the candidate from the list on question number two that gets the most votes will become the next Governor of California the day after the election is certified.
Will the Davis Recall.committee support a replacement candidate on the ballot?
NO! Our committee is committed to gathering the needed signatures and making sure that Governor Davis is recalled on the first part of the ballot. It will be up to the various political parties and individual candidate committees to support those that they favor on the second part of the ballot.
How do I know whether other groups asking for help are legitimate?
The simple test is whether they are circulating and asking people to sign the official recall petition. If they ask you to sign any on-line petitions or simply ask for donations "to help the recall effort" then you should be very suspicious. Look for the name of the proponent, Ted Costa, on the petition and any other information you receive. For any questions, call 916 482-6175.
Are volunteers going to be important to this effort?
Absolutely! The special interests here in Sacramento have given millions of dollars to Gray Davis and they do not want to lose their investment. Many of these interests are doing everything they can to disrupt our recall efforts. There are rumors that certain groups are actually paying people who would normally circulate this type of petition big bucks to NOT circulate the Davis recall petition. There are many plans in Sacramento to raise your taxes to solve the budget crisis and those promoting this DO NOT want a recall election late summer or early fall where the voters can effectively weigh in on the budget battle with a clear message of NO NEW TAXES.
Our volunteer effort is going to be the backbone of this recall effort. Tens of thousand have signed up to help and if everyone does their part we can meet our July 4th goal of collecting the needed signatures. Whether you can send in just a few signatures or can spend time in front of the super markets collecting thousands, your role is important. What are the rules for collection signatures?

Can anyone contribute and do you need more money?
YES and YES. Our goal is to gain the necessary 898,000 valid signatures on or before July 4th of 2003. This would force a recall election by September. If successful on this timetable, Californians will have a new Governor by the start of the new school year, and California will solve the budget crisis with NO NEW TAXES.

Dear Recall Gray Davis Group.
You did a very good job rallying the people who had been hurt by the corrupt Davis and his group.
Many association homeowners are angry with Gray Davis and his Davis-Stirling home foreclosure laws he write for the lawyers and other special interest. We promoted your recall efforts and helped round up signatures.
We also a left several calls regarding the homeowner association foreclosure corruption by Davis and the Sacramento politicians. No one called us back. So we are not sure if this is truly a grassroots or a political battle. We had also asked that you not use bad entrenched pro-foreclosure lawyers like Bill Morrow at your these gatherings. You ignored homeowners concerns. CNN reported that if the people of California had a way of recalling the whole corrupt Sacramento legislature they would.
We hope the recall succeeds..but we cannot in good conscience rally with the likes of the same crooked home foreclosing Sacramento crowd.
Grassroots should be grassroots. You should not be using grassroots fury with corruption to hold rallies promoting more of the same corrupt crowd. Party does not matter - people, their families and homes do matter.
You asked for recall groups to sign your list of groups supporting the recall. We did so and received no acknowledgement.
We will continue in our efforts in helping Gray Davis recall Gray Davis but not by attending rallies that promote other corrupt politicians who helped Gray Davis pass laws that hurt the citizens of California.

It's Official! Davis Will Face Recall Election
Enough signatures have now been verified to authorize the state's first-ever gubernatorial recall election.
According to the California Secretary of State's office, 1,356,408 signatures have been validated. A total of 897,158 confirmed signatures were needed to put the recall issue on the ballot.
Secretary of State Kevin Shelley had originally given local county election registrars until August 22 to report the total number of verified signatures. Last week, however, an appeals court ruled that Shelley's instructions were in error, and that the signatures on recall petitions must be verified immediately. The judge set the deadline for Wednesday at 5 p.m.
It is now up to Lieutenant Governor Cruz Bustamante to call a recall election within 60 to 80 days. California voters could decide on Davis' future as early as September 23.
Californians will likely be asked to first vote on whether or not to recall Davis, then to select a new governor. Although no Democrats are running for the office, several Republicans and Green Party candidate Peter Camejo have already announced their intention to seek the office. Recall Signatures Must be Counted !
Shelley Loses in Effort to Delay Qualification of Recall
(Sacramento) – The California Third District Court of Appeal has ruled in favor of The Recall Gray Davis Committee (website: www.RecallGrayDavis.com) and its chairman, The Honorable Howard Kaloogian, and ordered that the Secretary of State “maintain a continuous count of verified signatures submitted up to, and during, the current reporting period and to make that count available to the public upon request.”
In their ruling, the justices for the court concluded that directive given by Secretary of State Shelley which allowed for a 30-day delay for verification of recall signatures was “erroneous.”
“This is a terrific victory for the people of California who have suffered under the corrupt and failed administration of Gray Davis. I am relieved that the will of the voters who signed recall petitions will be upheld and not undercut by the political games of Gray Davis’ allies,” declared Kaloogian.
In the Alternative Writ of Mandate issued by the court, Secretary of State Kevin Shelley is:
“…directed forthwith to instruct local election officials that they have a continuing duty, during a current reporting period, (a) to examine and verify the validity of signatures on sections of a recall petition upon each submission; (b) upon completion of each examination, forthwith to submit to the Secretary of State a certificate showing the result of the examination; and (c) to report every 30 days to the Secretary of State the cumulative total of all valid signatures received since the time the recall was initiated…”
The courts decision means that the 1.6 million recall signatures collected and turned in before July 16 must be counted and verified. Since this is almost twice the 897,158 required by law, a special recall election will now be called by October of this year.
“The courts have spoken, and now it is time for Secretary of State Kevin Shelley to follow the law and serve the people of California as he was elected to do,” concluded Kaloogian.

It's never happened before but this fall, or no later than next spring, Gov. Gray Davis seems destined to face a recall election that could well end his governorship.
Davis supporters loudly proclaim this is an unjustified right-wing coup to undo last year's election results. They are right about the right-wing part, but wrong about justification. In fact, this recall is exactly what the Progressive reformers had in mind when they added direct democracy, including recall of public officials, to our Constitution 90 years ago.

California, the worst-performing state in the analysis, did the opposite. It approved huge spending increases and tax cuts during the boom. When the economy soured, the state began borrowing money and using accounting gimmicks to avoid its day of reckoning. Today, it continues to spend $1 billion a month more than it takes in.
In California, Illinois and other states that have managed money poorly, residents will be paying off added debt for decades. Tax increases and spending cuts will be more severe than they would have been had the states addressed financial difficulties quickly.
''We've slipped out of a tradition of good fiscal management,'' says Donald Kettl, a political scientist at the University of Wisconsin who studies state finances. ''California is an extreme example.''

In an interview with Judy Woodruff on CNN today, June 23, 2003, Davis stated that he wished to leave California better off than when he first came into office.
Now, we know what he meant to say, but his fundraising shenanigans leave us to wonder about the other meaning. He raised $78 million for his 2002 election - an unprecedented amount in California. What will he do with all the unspent millions that will still be in his pocket when he heads for the hills?
It would be interesting to know how much richer Davis is when he leaves office, as compared to when he first became governor in 1998. Does anybody have any figures on his net worth in 1998, and his net worth today?
As Davis hangs out at the state capitol, I guess it is true to say that Davis is a firm believer in "capitolism" - which, loosely defined, is capitalism while holding public office!

An AHRC member spoke to the Recall Gray Davis Campaign Manager to inform them about Gray Davis' role in the homeowner association foreclosure racket. He said they were not aware of this these terrible laws Gray Davis masterminded..

The power of our grassroots effort continues to shock the political establishment. When Secretary of State Kevin Shelley tried to block the recall petition and delay its approval we asked for your help. Thousands of you called and emailed the Secretary of State’s office until the logjam was finally broken and the Secretary of State cried “uncle” and approved the recall petition.
Last week we informed you that California Republican Party Spokesman, Rob Stutzman, slammed the recall drive. He told the Contra Costa Times that the recall effort was “failing” and that it lacked “broad-based support.” The only problem was that the delegates to the California Republican Party state convention voted overwhelmingly in February to endorse the recall effort. [This followed the bold moves by the Libertarian and American Independent Parties who officially endorsed the recall effort. This past weekend delegates of the Green Party were split and could not reach an official endorsement of the recall but instead will encourage individual party members who support the recall to collect signatures as individuals.]
After thousands of you again emailed and called to register your outrage that the spokesperson for a political party that had endorsed the recall campaign would then slam it to the press, spokesman Stutzman did a complete 180-degree reversal.
Radio stations 560 AM KSFO in San Francisco and 1380 AM KTKZ in Sacramento had Stutzman on their programs to explain his indefensible statements. Stutzman first tried to explain why he had characterized the recall effort was “failing” to KSFO’s Melanie Morgan. Realizing she wasn’t buying it – and neither were her listeners – Stutzman changed his tune and asserted to listeners that the recall effort was a good and healthy part of our democracy and one that he and the California Republican Party fully supported.
As Stutzman later told the Los Angeles Daily News: “…we think recalling the governor is an excellent idea."
Thank you to all of those who took quick and decisive action to let Mr. Stutzman and the executives of the California Republican Party know that their attempt to distance themselves from the 74% of Californians who disapprove of Gray Davis’s job performance (and overwhelming number of California Republican Party delegates who voted to support the recall) was unacceptable and intolerable.
