The fact that HOA's can save the municipalities millions of dollars, and places the burden and liability of infrastructure costs on the backs of "Joe Homeowner", is difficult to get past.
At its core, I have difficulty swallowing this 'rationale' for HOAs existence. Since the developer is 'required' by the cities as a condition of the zoning plan and development to pay for the costs of these improvements (even streets) initially, and since they are 'new' and most there will be no significant repair/replacement or 'maintenance' costs on those usual city provided capital improvements (streets, lighting, etc.) they are collecting revenue for a full at least three to five years before having to shell out any already collected tax revenue (sales, property taxes) in these developments.
It is governmental 'greed' pure and simple, most likely to justify the excesses that have resulted in their fraudulent claims of fiscal responsility and shove their need and entitlement for the increased salaries they were voted by the non-HOA property owners who are also benefiting from these owners in shouldering an overall lesser tax burden.
And I believe the U.S. and each state's constitution forbids this, but this is just a 'small detail.'

I wish this law firm all the luck in the world - but the enemy is far greater than it appears even they are aware. Include the real estate industry, banks and federal government and you will get the true picture (banks refinancing or originating loans in these developments are now attaching a Freddie Mac and Fannie Mae rider on the loans which imposes mandatorily additional restrictions upon homeowners in these developments, and a proviso that they be 'professional' managed, knowing there is no oversight or regulation of this industry in any state in the U.S.that I am aware of).
You've got a true 'government' acting in 'collusion' with industry and local 'government' to rob homeowners of their equity and property rights, and the ability to 'legally' protect themselves from any liability for their racketeering nor breach of 'the law of the land,' a U.S. Constitution they are sworn to uphold above all else.
I wish them luck in their pursuit, but the enemy is far greater than that which it appears they know.

How many more sealeezy breezey companies colluding with lawyers are doing this same thing? i suspect dozens. sure sounds like the oldest trick in the book - blackmail. only in hoa's, it seems to have been a legally sanctioned blackmail approved by politicians.
How many times have we heard the stories of foreclosure by hoa for pennies on the dollar in comparison to value of the home. merit less late dues quickly balloons into thousands of dollars in lawyer fees.
Can't pay? too bad. the association services p-scams and c-scams of clonevine will FORECLOSE on you.
Pray to God you are successful and hopefully dozens of other property managers and lowyers colluding to steal homes will be BUSTED!!!! politician$ who voted to pass these ass. laws should be jailed right along with 'em and they can all walk the wood bridge over the moat to the prison!
They just cai n't get away with this any longer!

As a respected journalist and lawyer - we wanted to forward this information directly to you.
The concept of homeowner association housing is a complete and utter failure and a financial risk that can cost homeowners their life savings and their homes (Nonjudicial foreclosure by HOA) .
Getting the legislators to recognize this has also been a failure as they listen to the ka-ching of money before they listen to their constituent's voices.
The fact that HOA's can save the municipalities millions of dollars, and places the burden and liability of infrastructure costs on the backs of "Joe Homeowner", is difficult to get past.
If this RICO action is successful, it will hopefully cause an unprecedented chain reaction of awareness across the nation and all those legislators, and so called "legal analysts", and HOA industry vendors and law firms WILL be exposed!

This was a long time in coming but much needed.
Here in Colorado, we will be beginning a series of meetings in Teller County regarding constructions defects and repealing CCIOA (the Colorado Common Interest Ownership Act) on April 12th. As 2007 progresses, we hope to expandour meetings to other counties all over Colorado.
RICO investigations -- especially of the CAI (Community Associations Institute) -- is never very far from Colorado's HOA homeowner advocates' near-future thinking and planning, these days.
