What can I do to help fight this trend of excess and excessive government without consent of the governed?

1. Get like-minded folks in your neighborhood together - do not attempt to do this by yourself. You need at least two other homeowners to build a clique and learn all about the "contract".
2. Infiltrate the board of directors, and tread very carefully and avoid letting them know that you believe in Castle doctrine...the board is probably already hand-picked by the management company and they only want people in there who will be good Stepford minded folk.
3. Once you have assumed complete control of the circle of power, use that power to educate the serfs in your fifedom about the Fascist regime that your developer put in place, and ask that everyone sign a petition to abandon the contract and change the entire declaration so that it can never have a Mandatory Association Foreclosing in America (MAFIA) collecting dues, fining people or even having to ask permission to make improvements.
4. Advise the owners that they are responsible to adhere to the deed restrictions, and that anyone in the neighborhood who violates the restrictions can be sued by anyone who feels they are harmed by thier failure to adhere. But there shall never be a MAFIA board of dictators to hire management/private investigators to inflict tyranny at the expense of the homeowners in any contract.

Since almost no HOA is a democracy (indeed, most have closed meetings where the important issues are disscussed and decided by a few people), and since new home owners are legally bound by accepting the covanents along with their home, there is really nothing you can do except:
COMPLAIN. LOUDLY. PUBLICLY.
TRY TO KEEP YOUR OWN NEIGHBORHOOD POLICE ACCOUNTABLE TO THE MAJORITY OF THE HOMEOWNERS BY PUBLICIZING EVERYTHING.
WRITE LETTERS TO REAL ESTATE AGENTS AND THE OFFICIALS WHO REGULATE THE BUILDERS---IF NEIGHBORHOODS GET NEGATIVE PRESS, IF BUILDERS GET HIT IN THE WALLET, THINGS WILL CHANGE.
