Andy,
Do you think that maybe intelligent and rational HOA homeowners in your state might be open to repealing your state's HOA laws?????

Jan,
Thanks for your comment. No, I don't have any illusion that our elected officials will follow the Constitution and protect citizens' rights over the interests of the deep pockets.
However, I have to have hope that enough people will eventually take action. I like your plan in Colorado. You may know Taffy and I ran for state legislative office in Georgia this year. Our main goals, if we had been elected, would have been to outlaw the Socialistic HOAs and impeach a few judges who think they are bigger and better than the Constitution.
In our legal purgatory of the last 7 years, we have PERSONALLY provided evidence of fraud and other crimes to former Governor Barnes, Governor Perdue, Congressmen Barr, Price, Gingrey, Isakson (now U.S. Senator Isakson), Congreswoman McKinney,
Senators Chambliss and Miller, Attorney General Baker, State Senators Wiles, Hill, Rogers, Georgia Representatives Ehrhart, Cooper, Cobb County Commission Chairman Olens, Commissioner Goreham, District Attorney Pat Head, and County Attorney Dorothy Bishop. As you guessed, all of these folks refused to take any action against their "friends."
In fact, the Senator I ran against, John Wiles, listed above, is an attorney whose firm, Wiles & Wiles, has a web address of www.EVICT.net. So, you know there's no help for property owners coming from him.
You are right, only We The People can change the horrible situation in this country, where our ancestors came to enjoy the unencumbered use of private property and Live Free or Die.
Keep up your good work in Colorado.

Andy,
You wrote: "What can the average citizen do? Notify your elected representatives and senators that you want them to call for an investigation of judicial misconduct." I feel your family's pain, literally! I filed a lawsuit against my HOA in Colorado last February. So I know from experience whereof you speak. It is not an easy thing we HOA homeowners are trying to do, i.e., fight corruption everywhere we turn. (sigh)
But do you honestly believe that your legislators will help you in your cause? We here in Colorado have already learned, through bitter experience, that many (if not most) of our legislators are in the pockets of special interest groups in our state. We tried to stop that mess through term limits. Didn't work. They just serve out their terms and then are hired by those same special interests as lobbyists.
So we HOA homeowner advocates here in Colorado have decided that only We The People (voters) here can fix the problem of HOAs. In 2007, we will be out and about all over Colorado with petitions to repeal our HOA/CID laws, i.e, the Colorado Common Interest Ownership Act aka CCIOA.
Perhaps you all in George could do the same thing?
