Ms. Rice is correct in her assessment of the media in the Atlanta area. I have lived in Atlanta for at least half of my life and you very rarely pick up a newspaper or hear news on the radio or television regarding the corruption amount Board of Directors of homeowner associations all across the metro area and Georgia.
I live in a neighborhood of 58 homes in Gwinnett County. I have lived in this subdivision since 1999. I have received one notice of up-coming elections for a new Board of Directors since I have lived here. I have never received a notice from the Board of Directors stating where nominations are to be held or when, where and what time to vote with the exception of the first year I lived in this subdivision.
The last recording by the Secretary of State shows the same person as Treasurer, that has been Treasurer for the last 5 years at least, it shows the other members of the Board of Directors as people who no longer live or own property in this neighborhood. We had a $20.00 per home in the increase of dues last year and to my knowledge as the Covenants of the Association call for there was not a 2/3's affirmitive vote by the homeowners to raise the dues. The last newsletter we received as we do every year when dues become payable listed the address of an Administrator that we were directed to address our complaints to in writing. The address given was a P.O. Box Address and the Administrator was not named.
I wrote the Administrator on April 17, 2006 requesting proof that as a homeowner and member of the Association, I should be entitled to. I received the letter back in the mail today, marked undeliverable by the Post Office. I know that there has been enough abuse of power by the Board of Directors over the past several years to file a legitimate lawsuit against the Board of Directors, requesting to see voting records, minutes of meetings, an accounting of how the homeowner dues have been spent and to call for a complete accounting of all Association dues collected, the expenditures and the reserves by an outside accounting firm.
There is also enough evidence to have the Board of Directors removed from office and ivestigated for inappropriate use of funds, while having the Association disbanded as it currently stands and either a new Association appointed to re-write the Covenants to bring them up-to-date with current laws and to afford the homeowners of this subdivision more protection.
The problem is as Ms. Rice puts it "Media Spin and Collateral Damage". Honest homeowners in a situation like I have described-above are generally ignorant of their rights under the laws of the State of Georgia and that is due to the media refusing to bring public awarness to this problem.
