Usual deceptive practices of the California politicians and the CLRC industry political appointee "Commissioners" who work for the foreclosure industry.
It is any wonder this long time entrenched CAI crowd identified and kept any experienced advocates from exposing their deception at these important California Homeowner Association hearings?

David Link - consultant to the Chair for the Joint Committee on Board, Commissions and Consumer Protection co-ordinated the California Ombudsman hearing and may be able to help. There is an office in the legislature that also sell the tapes on hearings.
The California Legislalture should be achiving and making all these available on the internet but the politicians and lobbyists want to keep much out of the public's view.
In January 2006, a news reporter doing a investigative report on the California Ombudsman bill asked Senator Alan Lowenthal, Assemblymember Gene Mullin and their consultants Hugh Bauer, Lisa Engel and Leticia Garcia for the records on the California Ombudsman bill. These are public records they are required to provide any citizen. They have so far refused to provide any records.

FISHY HEARINGS AND BACKROOM DEALING - California Ombudsman bill.
Assemblymember Gene Mullin and his consultants Lisa Engle and Hugh Bauer and Senator Lowenthal and his consultant Leticia Garcia have been meeting with CAI foreclosure lobbyists on taxpayer paid working time to write their bills.
They conspired and excluded homeowners and long time advocates who they felt would question non-enforcement provisions of an ombudsman from the meetings and panels they put on for they phony "televised legislative and public hearings".
They invited CARA, a recently formed industry and anti-homeowner politician financed 501(c)3 non-profit as the "spokesman for homeowners".
Industry paid lobbyists do not represent the public's interest. AARP, which makes money from drug plans and travel companies etc. sold out America's seniors when their industry paid lobbyist pushed through the disastrous Medicare bill that benefited the drug companies and then went to work for the drug companies for a $2,000,000. dollar salary.

Edmund Regalia is a political appointee of Governor Schwarzenegger. He was appointed chair of the California Law Revision Commission in August 2005.
His is partner of the lawfirm Miller, Starr & Regalia and his practice includes real estate law, title insurance and mediation services.
His clients include major developers and banks including - U.S. Bank.

In 2004 U.S. Bank lobbied against Homeowner Protection Bill AB2598 (Steinberg - Ducheny) along with the CAI, ECHO, CACM lawyers and managers. Governor Swartznegger vetoed AB 2598. See: Perry Communications
In Arizona the 1st National Bank of Arizona - Community Associations Banc is also a key member of the Arizona CAI and lobbies with CAI for homeowenr association non-judicial foreclosure laws.

Regarding the comment about lawyer Ed Regalia and his being on the California Law Revision Commission board, or whatever position he holds there....is there any potential conflict of interest issues if he and his lawfirm are involved with the real estate laws and also being in that position on the CLRC?
What was his position , I wonder about the Homeowner Association Ombudsman laws? Just curious!

What is Truthiness you ask?
First heard on the Colbert Report, a satirical mock news show on the Comedy Channel, truthiness refers to the quality of preferring concepts or facts one wishes to be true, rather than concepts or facts known to be true>.
Truthiness in Homeowner association language is Lobbyist, Politicians, Attorneys, and Vendors. These groups write the laws together wishing the facts to be true rather than what homeowners living in associations know to be true.
Once again homeowners will just have another 1-800 number to call when they need help. Homeowners already have a 1-800 number for FREE at the Attorney General's office which gives homeowners the same results, NOTHING. Homeowners will have no ability to enforce anything in AB 770, and AB 551. No sanctions in any Homeowner Association laws means money making lawsuits is the law.
Mullin's bill AB 770 written by the California Law Review Commission bears no resemblance to the CLRC Memorandum brought to the legislators.
Lowenthal's bill SB 551 gives HOA's another zero net result.
The Truthiness homeowners living in associations want is equitable enforcement of all pertinent laws without legal assistance filing a high dollar lawsuit.
In 2005 Ducheny, Battin, and Jones passed bills that give homeowners a small piece of the truth.

AUTHOR PROFILEr: I have lived in my homeowner association for 15 years. I have not been allowed to nominate myself to our Board, until the annual meeting night. This is after the Board sends a letter to the community telling the people they prefer. The Board members only allow a select group to be nominated.

Oh my oh my.........I really smell some old old rats here. As in possible Homeowner Association industry planted rats.
I have often wondered about certain so called "homeowner advocates" who seemed to come out of nowhere and USING bonafide homeowner advocates to further their agenda and using copyrighted AHRC information as well as the information of others and using it as if it were their OWN. What is up with all the different 'titles' this person has held and start up non profit orgs this person has been a member of that claims to be advocates for helping homeowners?
The amazing thing is the the Caliphoney legislators who give "credit" to this person, this group, yet they don't give true homeowner advocates, groups, writers, and journalists credit. How deceptive this all is.
Yup, something really smells to high heaven in the legislated halls of deception where the rats scurry in and out of the pockets of the pandered, leaving behind their infected dropping$.

Is the Regalia that is listed at the bottom of this article as the Chair of the California Law Revision Commission, the same one that is the Regalia with the law firm of Miller, Starr and Regalia as listed below from a cut and paste off of the internet site of Thomson / West publications and off the Cal State Bar website? Does this mean he is involved in writing the Real Estate Laws for the State of California?

Excellent and informative postings on keeping homeowners updated as to what is really taking place with this.
Homeowners against this bill deserve an explanation as to how this was allowed to happen.
