They have pulled out all the stops to prevent a former Board Member from being elected

YUP!! Same thing here in Irvine California. Their isn't a public call for candidates. If there is - they "forget" to put someone on.....over and over again.
The ballots are controlled by the management company who is controlled by the board due to paychecks.
The "ballots" were small 3x5 postcards, pre stamped, that were to be returned to the in-bred management company, therefore NO votes were secret and could easily be "lost", or blatantly "thrown out" and votes changed - take your pick.
The board in control got an entire page in the HOA propaganda newsletter to spew forth their vendetta - the "forgotten" candidates had to pummel the pavement and spend their own money in an effort to let the homeowners know who they were. When they tried to place an ad in the stupid "newsletter" - they were told they couldn't.
Yeah - it's called criminal in my opinion!!! But then, try to hold such crookery accountable - yeah right - got $350,000?
Even if you do get a court order for the election to be done legal and proper - they might just ignore it.
A board in the Turtle Rock Village of Irvine California ignored a court order to leave two lanes open at all times for the homeowners during swim league events. They told the homeowner - so take us back to court.
What about the homeowner in Texas who won a court order to view the HOA books and records - the board blatantly ignored that one too. And said the same thing about going back to court. They could careless - it ain't their mulah.
As for if there is an unspoken model on how to control HOA inmates - Yes - I believe there is. The patterns of bad behavior and corruption are too similar in HOA's across America.
The HOA lawyer, property managers, and board member chat rooms are likely alive and well and running 24/7.

Yes, it appears to be the same everywhere.
I was not even asked to submit information to be published for the Board election. Then, stating correctly (but a lie) that I had not submitted information, the Board was unable to set my name in type as large as the other candidates and they were unable to publish my address and how long I had lived in the development, like they did with the other candidates for the Board, dispite the fact that they obviously had this information on file.

I currently sit on an HOA board in Southern California. I have been on the board for almost a year and have been absolutely shocked to see how HOA's are run. Everything from personal vendetta's being exercised against specific homeowners under the guise of violating CC&Rs to poor research done on major replacement projects that have ended up costing the HOA tremendous grief and money.
This is not something that sits well with me as a Board member and a homeowner. I have chosen to stand up against poor decisions being made that are not in the best interest of the membership and have taken tremendous abuse at the hands of other board members for not going along with "their" program.
I would like to think that there are good boards out there and I have no doubth there are. Homeowners need to hold their boards accountable, attend meetings, ask questions and keep informed.
The more homeowners arm themselves with their rights, the better the chances are for effecting change.

Rigging elections means millions in legal fees from homeowner victims. CAI lawyers have been using the reserves of non-profit homeowner associations to finance their scorched earth litigation against homeowner victims who challange their control of boards.
David Peters - Peters & Freedman, the managment companies (the out of business Marquis Management Company, and Progressive Management) and the board of Palacio del Mar Homeowners Association that included realtor Malcolm Gillies, John Meyer (a disbarred lawyer), Raymond Kunkle, Walter Schminke and Tim Alman rigged the elections of Palacio del Mar Homeowners Association in San Clemente for decades.
1. They do not put names of candidates they want to exclude on the ballot
2. They illegally changed the CCRs to take away culmulaltive voting rights
3. They used judges who live in the association - Judge Kenneth Ziebarth to announce to the members at the annual meeting that David Peters runs "I an a judge and I checked the CCRs - they are perfectly legal">
We need a government investigation of millions of dollars and homes being stolen from 502(c) 3 non-profits by CAI lawyers like Peters & Freedman.

Amazing! I am a former board member here in Temecula California, Paloma del Sol Homeowners Association, just lost being re-elected and almost everything you describe about the other board member being prevented from getting back on the board has happened exactly to me!
Is there a publication somewhere that is circulated between HOA attorneys on how to rig an election? My candidate statement was not put in the voter ballot that went out in the mail. Other "favored, board majority members" who were up for re-election got to put their opinions in the bill that went out before the election, not me though.
Also, all proxies were mailed to the managment company (Merit) the day before the election, how easy to have "mis-placed" any with my name on them! the people that tallied the votes om the election day were all friends of the board majority and Merit, as well as the attorney! The month before at our board meeting in our board packet, the candidates resumes and statement were included and I used those to send out my own statement to the homeowners with my own proxies, little did I know that they were later declared all illegal.
Why? Because Merit had "accidentally" left out one of the candidates names from the board packet! They threw the bait out and knew I would take it, naive as I was, they are very cunning and experienced at this stuff, very few honest board members have a clue what kind of devious tactics they use. I would love to get the whole election declared illegal but of course, cant afford the attorneys fees! You can't win.
