Election problems??? Blame it on the legislators!! THEY are the ones that pass the bad laws that burden HOA homeowners.
Ultimately, the HOA industry vendors will do what they can to suck the lifeblood (read money) out of HOA homeowners but the legislators have the POWER to VOTE DOWN bad law.

Homeowners - be very careful about using lawyers in HOA related litigation. Litigation is extremely risky.
Due diligence is a must. As for me personally, the term "Ombudsman" being used by anybody makes me nervous as it is the current trend being forced upon homeowners by legislators.

A couple of homeowners are looking into setting up a pro-per self help membership website for homeowners.

Most of us cannot afford an attorney and have found it far better to study the law -- for which there needs to be special place on the AHRC website -- for those in pro per.
DO NOT BELIEVE AN ATTORNEY WILL BE OF MUCH HELP!
I have not found that to be true at all.

I empathize with your situation...I own a property in Aliso Viejo, California,
AVCA is the community association which is managed by Merit Property Management . We too have a possible election fraud---a delegate voted during the AVCA election and was not permitted for she had not been voted in by her sub association.
Nobody wants to look into and we have been told if we wanted to do anything about it, to file a lawsuit....It's just too much of a coincidence that Merit was the management company of the sub association and the AVCA association at the time of the possible fraud.
Usually our elections are in June but Merit has pushed to have it done sooner so they don't have to abide by the new laws....Good luck and if you find an attorney willing to take on something big, have him contact me!!!!

Listening to your complaint, I can understand your frustration. I'm going to give you the name of a lawyer, but I will tell you ahead of time, it will cost money.
In my HOA we legally elected an interim Board and the old Board refused to leave.
They then used our own money to sue us as individuals. Our only alternative was to turn to the individual homeowners in our HOA and ask for donations to fight the Board. We eventually won in court using this lawyer.
20/20 hindsight shows that we were lucky. The first thing you must do is become an expert in your own CC&R's and By-laws.
You should also have a hard copy that you can provide to anyone who attempts to help you. Without these, those who would like to help don't know the rules.
