My husband and I are very interested in being apart of a collaborative effort to help keep HOA Management Companies from continuing in the excesses and abuses that we have experienced recently.
Thank you for providing such a forum for people who feel very helpless against the attorneys which represent the interests of the management companies and are not to a greater degree servicing the needs of the homeowners.

I believe that a Homeowner Bill of Rights for Georgia is not only necessary but is the only way that the average homeowner living in a subdivision where an Association is present run by a bunch of self-serving individuals known as a "Board of Directors" will have the ability or a process to stop illegal abuse by these so called "Board of Directors". I currently live in a subdivision of 60 homes with Association dues of $200.00 per year.
The $200.00 per year is for the upkeep of all common areas (which amounts to the front entrance) and a pool that is so small that if more than 4 adults try to use the facility at one time, it is considered crowded; therefore; no one uses the facility. Since I first moved in to this subdivision in 1999, I have seen information regarding the election of a new Board of Directors distributed to the homeowners one time. I have never been able to exercise my right to vote in person or by proxy because the Board of Directors does not make the date, place or even the election process available to the homeowners.
The only time you hear from one of the people on this alleged Board of Directors is when the Treasurer sends out the one "Newsletter" we get every year telling us how much dues are for the year and when they are due followed by a threat of filing a lien against your property unless your dues are paid by the deadline printed in the "Newsletter". I have not seen a list of the people on the Board of Directors, their names and positions in over 3 years. It is obvious that this subdivision has been taken over by a group of power hungry self-serving individuals who are ignoring each homeowners rights as defined in the Covenants but who are in effect running a secret society or Dictatorship for their own personal gain.
One of the biggest problems I have found is in talking with my neighbors, everyone agrees that something has to be done; however; there is never an organized effort to do away with the Association as it stands today and have it replaced with a real Association run by covenants that are updated and are written taking the idea's of all of the homeowners in consideration. It seems that unless one person or a group of people get together and take this problem by the hand and lead the rest of the homeowners in a legal action to disband the current Association and the Board of Directors that everyone is content to pay their $200.00 per year as long as the current Board of Directors leaves them alone.
The sad thing is that if 100% of the homeowners pay their dues that means the Association or Board of Directors takes in $12,000.00 per year. The homeowners then have no idea how the Board of Directors spends this money on upkeep of the common areas and the pool as called for in the Covenants but also has no idea as to what happens to the reserve that is left over each year as the Board of Directors have not been held accountable to use the reserve to expand or put in any new facilities that might upgrade property values or as is called for in the Covenants, the money should be used for the general well-being of all of the homeowners of the subdivision.
Therefore; I believe that the only way a Homeowners Bill of Rights will be adopted for the homeowners in the subdivisions located all across Georgia is for all Georgia Homeowners to pull together and pool their resources to attack this problem at the State level rather than the local level. I for one would be in favor of developing a State Level Homeowner Advisory Board to coordinate and strategize as to the best way to create a valid and strong lobby for a Georgia Homeowners Bill or Rights.
There are strength in numbers and unfortunately right now in small and large subdivisions across Georgia where corruption and discriminatory actions are put-forth against homeowners everyday by the corrupt Board of Directors, the majority of the homeowners are generally apathetic and not likely to get involved unless they are one of the homeowners caught up in the corrupt actions brought against them by these illegal "Board of Directors". That is why I believe that a organized State-Wide approach to restoring the rights of the homeowners of the State of Georgia is necessary. I am calling for all Georgia Homeowners across the state who believe that a Homeowners Bill of Rights is necessary to protect the individual rights of Georgia Homeowners come together and start by organizing an effort to launch a State-Wide attack against the corrupt Homeowner Associations running rampant across the State of Georgia.
I am personally willing to devote my spare time to organizing a State-Wide effort and I am asking all of the homeowners out there who are interested in preserving their rights to feel free to contact me or come up with the name or names of individuals who you feel are qualified and dedicated to such a movement so that we can quit wasting our time fighting this problem by spending our resources putting out small fires and create an Advisory Committee or Advocacy of people that have the will to make the idea of a Georgia Homeowners Bill of Rights a reality.

I am a resident of Kennesaw Georgia and want to try and work for the same cause. Do you know of local political leaders or action groups that are getting involved with issues to protect homeowner rights?

Your document is excellent and one I would love to see become part of Georgia's law books. I am a homeowner in Kennesaw, Georgia that is currently in dispute with my HOA Board.
The past 6 months I have come to understand how dangerous to homeowners these unregulated Boards can be when combined with ambiguous and outdated covenants.
I am looking to find some vehicle or action committee, legislative entity, etc. that I engage with to try and seek long-term solutions for Georgia homeowners. I do not want any of my neighbors subject to the situation I find myself in.
Do you have any suggestions?

As a resident of the same subdivision and member of the same HOA as Mr. Holley, I find it terribly interesting that he has drafted this Homeowner's Bill of Rights.

I am an attorney who has worked on homeowners association matters for over twenty five years and lived in either a condomium or an HOA for most of those years, member managed associations, and for the last three years most of my practice has been to represent homeowners in dealing with conflicts with their associations, I recently established an LLC here in Common Interest Owners Legal Advocates.
What your fighting for is hugely important however I have to tell you that I think your preamble, while absolutely right in it's points is way to harsh to effectively aou dvance your cause. I 'd be glad to help you refine that to present that message more positively if your interested.
