They are currently filing a case about mid-eastern looking people being searched "at random" in New York subways???
Another loser for the ACLU.
They won't touch HOAs because they lost two cases -- I could have told them they would lose as they DO NOT know HOA law.

Yep! Been to the FBI -- the police got there first and convinced them I am "crazy".
Yep! Been to the District Attorney -- the police got there first...
Attorney General, LOL -- never even answered.
NOW, I am going to the next City Council and making a Citizen's Arrest on the Chief of Police! And, on a couple of Council members.
Pray for me. :>)

I too have suffered with false charges filed against me concerning an incident involving Comcast cable. A month before an arrest warrant was issued by the Police department in my town for my arrest on these false charges, Comcast has sent a letter (which somehow was temporary lost in the mail) saying these charges were dismissed by Comcast when they realized the charges were false that were filed by a Comcast sub-contractor. The Police seemed to act like they never got this notification.
The arrest warrant marked a life of 63 years of never having an arrest of any kind, on any charge (in fact in the last twenty years, not so much as a traffic ticket). Since our Police department "serves at the pleasure of the City Manager", it was the belief of my attorney that I became the target of "Official Oppression" which is a crime that may be proven in the future on the part of the Police Chief, the head of the Crimial Division and the Police Detective who conducted the "so called investigation".
The crime which documented proof exists for, would place these three individuals in the county jail for six months with a four thousand dollar fine.
My suggestion to this individual is to file charges with the local D.A.'s office against this Police Department personnel under the "Official Oppression law". If they refused take the charges to the office of the Attorney General's office of your state. They generally have sub-offices in each major city in a state. I might point out that these charges of "Official Oppression" were traced to the orders of and further false documents given to the local Police Department by a current Board member of my HOA and another past Board member.
The reason: I refused to spend over $50,000 of HOA association money to fix retaining walls for a select group of homeowners along, what was discovered to be an utility easement. These homeowners were powerful retired politicians who had worked for my city at one time or another.
Yes, corruption in local Texas cities is alive and well with ties to large HOA's and local city government. In many cases those who end up on the city council start their political careers as Board members of their local HOA. Those who try to do what is right for their neighbors "get stepped on.....hard". Crooks and thiefs are part of this exclusive club.

What Earl Moss does not say, is, through a conspiracy to save two officers, the CCPD took out a restraining order to keep me from making a police report against the two officers who went to Pepresentative Bonnie Garcia (R) Office and slandered me to the point I was put on a "Threat List" in Sacramento, California.
There has been no investigation to this very day on this event.
And Sergeant Moss has repeatedly harassed me with nasty comments, threats to "get out of town," and, telling me "to come out of the darkness of sin I am in."
He is terribly angry at me, particularly when he lost a case to me -- as a pro per -- and has had a vendetta against me since 1999. He does not know or understand Penal Code, and some of his fellow officers have said he did not even pass the Sergeant's Test to get into his current position.
He has made a provable false police report to the Palm Springs police about me, and, he has had me falsely arrested.
Yet, he is the only one I am allowed to speak with, and often he just ignores my calls.
I have spoken with the FBI, and I have spoken with the District Attorney -- and I believe I am getting somewhere.
I have also spoken with an attorney who recognized immediately that this bogus Restraining Order is nothing more than a vendetta.
Of course, the $65,000 they charged me for a bogus investigation, that proved nothing but their own conspiracy, will need to be handled in a lawsuit.
And, so it goes...

I read articles like the one I am posting a comment, and I wonder if this is a true story!!!!!
If it is, the party involved in the arrest can file a complain with the FBI and request help from the ACLU.
Is this USA or Germany 1939?

Sharon has been battling her Homeowners Association for several years now and there never seems to be an end to it.
My HOA is also attacking me also via the Palm Springs Police Department refusing to take or investigate my complaints any further than to send out an officer who listens and then does nothing about the abuse of false police reports by my HOA renters and other owners in my building.
My complaints to the Desert Sun Forum was ignored until I finally claimed I was going to Palm Springs Police for the defamatin and harrassment by Cory Johnson on the Forum.

Dear Sharon:
God bless you, you poor thing. I am so sorry for the abuse you are being subjected to, however, you are not alone. I and others are suffering similar fates, however, to date I have not been arrested. The police were called out to my house by the Association's contractor, however, I refused to be bullied by him, and after he left, I contacted the watch commander and filed a complaint.
Hang in there. I believe that everything will turn out okay in the end. I have to believe this or there would be no reason to get up in the morning. I believe that some of us have to be the ones who suffer in order to bring about change for everyone. You are blessed, as I believe am I. I will keep you in my prayers.

Yes, Sergeant Earl Moss, or Cathedral City Police has told a blatant lie in this article when he said "there is a restraining order against me for tying up 911 calls"
NO! The very morning he reported this to AHRC he had just given me a police report that he admitted was false, and that a supplement had been added to it that cleared up that FASLE report. He also gave me a dispatch tape that proved I was only trying to make a police report, but was falsely arrested anyway.
The dispatcher, Danielle Pascual who had me arrested then admitted in court that I was NOT making abusive calls, just trying to make a police report. She went on to tell the judge that she had no problem making a police report, taking 911 calls, and doing her other duties. THAT is in the court transcripts.
In other words, she had me falsely arrested, with the encouragement of her Watch Commander, Sergeant Charles Robinson who did not want a report taken, because it would have been against him, and another officer for going to Assemblywomen Bonnie Garcia's Office and slandering me to the point I was put on a "Threat List" in Sacramento.
Sergeant Moss waited to allow me access to the report and tape hoping that the statue of limitations ran out.
Deputy City Attorney, Kendall Berkey KNEW her plaintiff, Danielle Pascual committed perjury in a police report, and a personal declaration, and had me falsely arrested!
The Restraining Order, Robinson et al v. Sharon Stephens was for no other purpose than to keep me from making police reports. With Earl Moss as the only person I can talk to, he just refused me any police reports on criminal acts.
Berkey was awarded $65,000 for a bogus investigation, that went on for months behind my back, that proved nothing but a conspiracy, in which she names, such people as Bonnie Garcia, a Deputy District Attorney, Charles Gianguzi, Journalist, Cindy Uken who wrote a libelous article in the Desert Sun, the board members of my HOA, and of course Sergeant Earl Moss, and Chief Stan Henry.
These are the people she conspired with to save two police officers.
I also caught Earl Moss giving libelous reports to the Palm Springs Police Department, on a case where I was the victim, and since then he has set me up twice to be arrested when I come to Cathedral City Police Department to pick up things such as this police report and tape.
He will not take any police reports, or arrest any of the board members who have battered me, and stalked and harrassed other women and children in our HOA.
WHY? Because he says I "don't act enough like a victim." !?!
He won't file any criminal reports for the embezzlement of more than $60,000 by the attorneys, and board in our HOA, constantly saying it is "a civil matter." Moss even told me he talked to two attorneys, but when I asked him their names, he told me, "Go pay for your own attorney!"
Now, before anyone thinks these things are "civil" consider [CA Penal Code]: "Crimes Against Public Justice" are found in Part I, Title VII of the Penal Code, made criminal by legislative enactment, Section 182, subdivision 5.
That means such things as embezzlement, extortion, fraud, conspiracy ARE criminal and the police can take crime reports against your HOA attorneys, board members, or management people who do such things.
We must continue to fight for our rights.
Being an advocate has never been easy, and I just remember all through history, those who fight for what is right will always be falsely arrested, slandered and lied about.
It is our legacy.
