CALIFORNIA SENATOR DUCHENY RE-INTRODUCES LEGISLATION TO PROTECT HOMEOWNERS FROM FORECLOSURE
SB 137 will prohibit Homeowner Associations from using non-judicial foreclosure for delinquent assessments under $2500

Today, the California Senate Judiciary Committee voted 4-1 to pass SB 137.
SB 137 would provide that when a homeowner association seeks to collect delinquent assessments of less than $2,500, not including specified late charges and fees, the association must either file a civil action in small claims court or record a lien upon which it would be prohibited from foreclosing until the amount equals or exceeds $2,500.
It is identical to AB 2598, a bill that Governor Arnold Swarznegger vetoed last year.
The homeowner association lawyers and managers continue to lobby heavily against the pasage of the bill.

The anti-homeowner lobbyists will ABSOLUTELY replay last year's successful effort to persuade Gov. Arnold to veto this critical law if, once again, California's elected legislators dare to place it on his desk for signature.
No matter how we lobby our individual legislators, the Governor has the ultimate veto power to gut this year's bill as he did last year.
Homeowners must support Senator Ducheny's bill -- AND bombard our Governor with emails, faxes, telephone calls and letters informing him that his veto last year was a slap-in-the-face to everyone living under the domination of a homeowners' association!

This bill may hopefully stop "non-judicial foreclosures" for small delinquent assessment.
But I am concerned it may not stop unlawful detainers being used by associations, probably mostly cooperatives, whose by-laws provide for that method of kicking people out. The wording may need to be changed to protect all.
