Dear Governor Arnold Schwarzenegger:
it took consumers many years to finally get to the point where a Governor is being asked to sign anti-foreclosure bills into law.
As the People's Governor please listen to the people, your constituents. They have suffered long enough from the abuses dished out by special interests, mostly a well
know trade organization named Community Association Institute.
Even if they try to say otherwise they are a trade organization representing the interests of a very small minority of specialized attorneys and community managers.
And if you look at the quote in a recent newspaper article by Associated Press (quote): "Molly Foley-Healey of the Virginia-based Community Associations Institute calls Ducheny's approach an anti-consumer bill masquerading as a benefit to consumers," you know exactly what I'm talking about!
I can understand that they are afraid to lose a great source of income for little work!
In my opinion they have used homeowners in associations long enough as cash cows.
This has to stop! Please help homeowners by signing these bills -- especially AB 2598 (Steinberg) and SB 1682 (Ducheny) when they come before you!
There is a reason why homeowners' associations are considered illegal in the countries we came from!
The countries in Central Europe don't allow the creation of homeowners' associations.
Many homeowners from all across the nation are looking at California and you to make the great step of protecting homeowners. We are trying to achieve the same here in Florida!

Dear Governor Schwarzenegger:
Homeowners are finally getting relief from the draconian foreclosure practices that California has granted to CIDS/HOAs/Condos/planned communities.
I ask, "Why should private, undemocratic organizations be allowed to use non-judicial foreclosure in regard to homeowner associations when the business of an HOA is not the lending of its resources to the homeowner, as a lender of mortgage company?" No funds are advanced to the homeowner that requires a "penalty" for the "use of the funds". All other penalties are strictly punitive, a right of the government.
HOAs should have the right to collect on the monies owed, but why was it necessary for the state to enact laws that creates a special class of citizens that benefits the HOA? The equivalent of a failure to pay assessments is easily identifiable to the failure to pay state real estate taxes. However, in the tax foreclosure, the homeowner has a 5 year redemption period. Not so with HOA foreclosures.
Please support AB2598 and SB1168 and bring justice to hard working homeowners and let the HOAs find another alternative to collections for non-payment of HOA "taxes".
Like, learning to survive as any state or city has to survive with
their fluctuating income streams. Now, that's not too difficult, is it?
Don't let the hysteria of the business trade group, CAI, and other proponents "lean" on the state to make life easy for them and those who oppose these bills. They do not represent not the homeowners nor the associations (both are
consumers), but those living off the existence of disharmony, adversity and confrontation within HOAs while promoting a false view that all is well in HOA-land.
Please sign these bills when you get them.
