Good folks working in the legislative offices in Sacramento tell us that citizens have "an unlevel playing field in Sacramento when influencing legislation.".
The Santa lobbyists hang around politicians waiting for contributions to wine, dine, "advise" , "influence" and reward legislation that gives them what belongs to the homeowners.
The also hang around the Sacramento news bureaus providing their "expert" opinions, and reporters quote their misleading quips.
Homeowners should observe, expose, get involved to get what is rightfully theirs from their governor, legislators and the media.
Homeowners pay for the services from both legislators and media. They have a right to ensure that they , not bribing vendors hanging around legislative chambers, get what they pay for.

Dear Governor Arnold Schwarzenegger:
it took consumers many years to finally get to the point where a Governor is being asked to sign anti-foreclosure bills into law. As the People's Governor please listen to the people, your constituents.
They have suffered long enough from the abuses dished out by special interests, mostly a well know trade organization named Community Association Institute. Even if they try to say otherwise they are a trade organization representing the interests of a very small minority of specialized attorneys and community managers.
And if you look at the quote in a recent newspaper article by Associated Press (quote): "Molly Foley-Healey of the Virginia-based Community Associations Institute calls Ducheny's approach an anti-consumer bill masquerading as a benefit to consumers," you know exactly what I'm talking about!
I can understand that they are afraid to lose a great source of income for little work!
In my opinion they have used homeowners in associations long enough as cash cows.
This has to stop! Please help homeowners by signing these bills -- especially AB 2598 (Steinberg) and SB 1682 (Ducheny) when they come before you!
There is a reason why homeowners' associations are considered illegal in the countries we came from!
The countries in Central Europe don't allow the creation of homeowners' associations.
Many homeowners from all across the nation are looking at CA and you to make the great step of protecting homeowners. We are trying to achieve the same here in Florida!

Letter to Florida Legislators - Governor Jeb Bush:
Dear Governor, dear Legislators, Friends and Members:
Below is the copy of an e-mail I sent to Governor Arnold Schwarzenegger in California this morning. It is time that the truth comes to light and I can only hope that CA will be the first state to stop the many lien and foreclosure abuses owners in associations are suffering from.
I hope to write a very similar letter next year to Governor Jeb Bush. We homeowners need reasonable protection against the many abuses dished out by special interest, who hide under the cover of representing the consumer and protect their welfare. See quote of a CAI Executive below.
But we can already see that the tides are finally turning and more and more legislators all over the nation see the need of protecting their constituents!

To expect any VOLUNTEER HOA board to be able to COST EFFECTIVELY administer AND MAINTAIN a HOA is unrealistic. Assume for the moment a 100 unit condominium project with an average value of $250K per unit.
Thus,
(1) a VOLUNTEER board is in charge of $25 MILLION PROJECT.
(2) the UNPAID PART TIME board is expected to act like a PAID FULL TIME BOARD.
(3) The board hires a management company which provides OFF-SITE rather than ON-SITE property management.
(4) Unlike a SINGLE FAMILY HOME where YOU AS THE INDIVIDUAL HOMEOWNER make the PROPERTY REPAIR DECISIONS-i.e. You make the decision to fix the house, in an HOA the decision is made by the HOA. NO ONE TAKES CARE OF YOUR PROPERTY BETTER THAN YOURSELF!
All the legislation ignores the fact that HOA's are FUNDAMENTALLY flawed.
