Attorney Sharon Bush is writing a textbook for Homeowners Associations. Sharon, what would it take to make finishing it a top priority for you?
Since beginning my study of HOA law and real world problems, I have understood this: members hold the solutions in their hands. And members need leadership.
A statewide organization of homeowner advocates that would create a qualification test for board members would provide it. They could set a standard by which advocacy groups bring education to their community. A statewide non profit, privately run homeowners advocacy could certify persons as qualified board members, perhaps in different areas of expertise, the homeowners answer to CAI's CACM.
This test may or may not have study materials (the law and common sense is currently available)
The second phase of action for this advocacy group would be, using educational materials that would be developed by people like Sharon, create a one or two year study guide dealing with problems in the pro homeowner mode. Small groups of advocates in any association could start regular meetings dealing with topics that inform and could become a way to prepare for the certification test.
We do not advocate that associations be forced to elect certified members. However, it would give hope, a goal to reach, allowing members to decide for themselves on behalf of their community what level of professionalism they will demand of their elected representatives.
There are many solutions to HOA problems that lack of organization and lack of knowledge prevent members from using. On the other hand, we are finding that a knowledgeable group can be extremely small and yet create leverage, like the sling shot David used to down Goliath. Members need to kill the corruption without destroying their association...few currently know how.
