Three homeowners in the Dana Vista Homeowner Association in Dana Point California filed a Small Claims Court action against the Homeowners Association for failure to provide meeting minute and accounting records on numerous occaisions over a six month period.
We provided reams of documentation, cited the law, and presented documented cases where the Homeowners Associations were penalized for not complying with homeowners rights.
Judge Michael McCartin at the Harbor Justice Center in Laguna Hills presided and it was clear to us at the outset that he had no intention of ruling in our favor.
It didn't matter what evidence we presented or what we tried to claim as our rights under California Civil Code 1364.
He made us feel that we had simply wasted the courts time and that it was people like us that is the cause of high association dues!!!
Avoid his court at all costs - he is obviously not interested in the rights of those of us under the dictatorship of HOA's!

Justice defined is Just Ice.
The cold slab of justice is that place where participants are sliced, diced and served up as part of a litigation feast for lawyers.
The ingredients for "justice" are carefully measured out to benefit only the gluttons at the table.
Dessert is a hefty slice of "home sweet home", unless of course they decide to just eat the whole house.
