Other Information: This still leaves us in a quary on how to pay for common lands. An election/ bylaw vote (41yes/10no) was held without notice mailed to all stakeholders,(1,000 plus) although they posted it in small country paper. We live in a unusual neighborhood, individual homes mostly 2nd home owners,who live all over thr world therefore the paper was inadequate notification." Re: Sherwood Forest Neighbors Association
Dear Dr. Edwards:
Thank you for meeting with us on Thursday, December 9th to discuss the notices of assessment mailed by the Sherwood Forest Neighbors Association (SFNA) to residents of the Sherwood Forest community of Becket, Massachusetts.
We appreciate your view that the SFNA is responsible for maintaining the Common areas in Sherwood Forest. You agreed to consider holding a special meeting and election of the SFNA to ensure that the SFNA properly reflected the views of all residents of Sherwood Forest who wished to participate in the organization. In order to prevent divisive litigation and to ensure that resources are devoted to maintenance of the common areas, an appropriate solution will require that all stakeholders--including all residents who have an interest in the common areas-act together in a consensual manner. In addition, with respect to the notices of assessment, you agreed to the following:
1. No deed or other document filed with the Registry of Deeds contains any reference to assessments by SFNA or requires residents of the Sherwood Forest area to pay assessments.
2. The SFNA assessments are not taxes and do not have the legal status of taxes. Under current law, Sherwood Forest residents have no legal obligation to pay the assessments.
3. The SFNA does not have the authority to enforce the assessments by use of liens or attachment of the property of Sherwood Forest residents.
4. The only document that refers to assessments is the By-laws adopted by SFNA in
2003, The By-laws do not provide for enforcement of the assessments.
You also agreed that the SFNA would undertake to inform and educate the residents of Sherwood Forest's concerning these matters. In addition to a clear and plain description of the problems affecting the common areas and a clear and well-documented budget for dealing with these problems, all residents should be informed of the points set forth above. The SFNA should also inform all residents of the opportunities to participate in the governance and activities of the SFNA.
Because we have received a number of complaints from community residents, the special meeting and transmission of information to residents should occur in a timely manner. We would appreciate your sending us copies of SFNA's communications with residents concerning these matters.
Lastly, we understand that a number of the property owners have retained Attorney Nicholas Parsenios of Lee, MA to represent them. We believe that the most expeditious way for you to create the process for resolving the issues outlined in this letter is for you to contact him directly.
