I too called and wrote to our Attorney General's office and was told that they do not handle these type of issues. And, suggested we hire an attorney. So.... can someone tell me just WHAT DOES the Attorney General do?
I sent an email to the 'Governator', and got an email back saying "due to the sensitivity of this issue, please write your complaint in letter form and fax it to this number". I wasn't foolish enough to sit down and type up 200 pages of HOA corruption, remedies tried and failed via attorneys, California Real Estate Department, Attorneyy General, California Corporation Code representatives, etc.
I knew I would get the same answer that I got from the Attorney General. A boiler plate letter referring me to an attorney. There are numerous bills in legislation in effort to help the homeowners in HOA's, but none of your representatives are interested addressing them. One was representative was quoted as saying "you don't represent enough of the votes", (to make his efforts worth while).
And as you search each and every website for advice, you will ultimately see that the ONLY party that benefitted from hiring an attorney to represent you and/or the HOA, is the attorney. They are useless and love these kind of cases because they know they will lose your case but not your money.
The bottom line is, sell, and don't buy again in a Homeowners Association. You don't have anyone to police your corrupt association and there are thousands and thousands of corrupt associations nation wide.

I too contacted the Attorney General's office for help with a corrupt HOA in Southern California and got a letter telling me that "The Attorney General's office does not deal with these type of issues". Neither does the Secretary of State or the DRE if your HOA is not a corporation.
I wrote to the Governor and got a letter back immediately stating that his office was interested in hearing my story. I'll be sure to include my disappointing experience with the Atty Gen'l and Secty of State.

Take the letter from the California Attorney General and give a copy to every homeowner.
Even if the BOD thinks they can blow off the AG, I am sure they'd be very embarrassed if every homeowner knew that their HOA got a letter from the AG telling them they're outside the law.

Our complaint to the California Attorney General was a waste of time. Yeah, the board got that stupid form letter warning them about their 'recalcitrant' behavior, more than once, but they ignored it. i would not be surprised if the HOA industry vendor attorney just told them not to worry about it knowing the Atteney General's office would not waste time prosecuting because "it is a civil matter."
Not only did the board ignore the Attorney General's stupid form letter, they even ignored a court order.
Of course, the hoa industry vendor lawyer LOVES it when the boards ignore the law because that just means more money in his pocket.
More HOA trouble = more money for HOA lawyer
The only recourse a homeowner has is to spend tons of money and go back into court to try to enforce a court order. yeah right. that would only be double financial suicide and an even richer HOA lawyer.

The only attorney I could get to return my call wanted $1,500 down and $250.00 an hour to handle my case.
I know you have to make money, so I guess it is true the rich gets richer and if you can't pay, you lose.

Does California have an economic-crimes unit?
Florida does.But every agency that takes our tax dollar's,all told us hire private counsel.
Unfortunately with us, if you read our story our first attorney never filed papers-Jared Kullman.Our second attorney did not act as our advocate in the courtroom,we felt the written paperwork Gary Maisel was O.K.,but it has now been brought to our attention that he put information in that hurt us.
When we read the Linda and Robert Hammer foreclosure case,written in St.Petersburg online Maisel,followed a very similar format in that case,as he did with us.
Maisel never brought up any of his written arguments.Maisel never even put Hortensia Rodon or Carlos Rodon up on the stand.
I bring up Linda Hammer, a colon cancer patient undergoing chemotherapyas, because she lost her home in lower court to Maisel (our attorney) for $450. HOA fee's,.
She WON on appeal,and her community were against what her Homeowners Association did to her. It is one of the few stories that turn out good on behalf of the homeowner.
With us,we had already paid two attorneys who did not act in our interest.
We filed our appeal Pro-Se and we were denied a basic continuance,and hearing,after we supplied a police report showing that my family, and Hortensia Rodon was mugged,with neighborhood witnesses. Detectives took pictures of Hortensia bloodied. A, ll we asked for was a 4 week one time continuance,something attorneys get all the time.We were denied.
The legal system doesn't want homeowner's or average citizens to appear in court without paying $300. an hour to lawyers.
.What does one do? We pulled up other Homeowner Association foreclosures in our area.
The majority were Hispanic,Minorities,and Immigrants. We even contacted some of them.

Here is the scoop. Attorney General will send your board a letter. That's it!
Our assistant. City District Attorney says Sacramento has NEVER prosecuted a homeowners association.
Do you really wish they would? His duties include shutting down the association, shutting out board and management AND during the time of an Homeowner Associations "incarceration" one cannot sell property..this may also mean banks would refuse to refi. It could take 18 to 24 months or longer to resolve, its done through the courts. Attny Gen appoints an "interim manager," no doubt it could be a CAI buddy.
Be careful about inviting the government in...(you think your HOA is corrupt?)
I rarely see solutions here. If there are none, then all functional individuals should run from dysfunctional Homeowner Association, is this not true?
AHRC has been heroic in letting the problems be known. Now its time to get to the point., or are we using this site just to sound off...?
Two years of intense research has revealed here is a better way then suing ourselves and we are preparing to drop a hatchet on our association within the next two to three months...there are powerful outsiders who stand to lose if an association breaks the law and invites lawsuits...and there is a way to trigger their action without enriching attorneys.
However, preparation has required so much time and dedication, we hope the benefit will spread beyond our Homeowner Association boundaries.
