Steve, I just came across your article and your "lawsuit".
I have been involved in unsolvable problems with my Homeowners Association for about two years now and have been under extreme distress. I travel a lot and when I come home I don't know what will be next.
See:This is my HORROR story!! - The management company and the Homeowners Association attorney set one trap after another to keep me trapped in lawuits
They have sued me for not re-surfacing a balcony "Properly"
in which case my balcony is in a lot better condition than other balconies and the common area walkways.
The bottom line is that there are a lot of other problems with the property that the Homeowners Association does not realize because of the Management Company's neglect and this is their way to distract people from the real problems like PLUMBING, TERMITE ETC.
What was the outcome of your counter-suit?

I would aslo like to congradulate you on a job well done.
I only have one question,
What is the name of the Attorney for the Texas Secretary of State, that gave you permission to seek the Revocation of the Association's Non-Profit franchise?
I think I may be elageable to also get permission,in my case.
I am currently just waiting, as my case is in the courts until my September pretrial date.
Of course the Associations lawyer have had the case posponed several times now. I think this last time was the final straw with the Judge.
Several of the owners started out on our case against the Association back in early 2002.
Most of the owners here are elderly retired senior citizens.
I am a youngster in compareoson.
My only wish is to help these older Americans get their dignatee and rights back. Then they can live the way they have always dreamed the rest of there final days would be.
They can stop worrying about loosing their homes to a trumped up violation charge. It would be nice not to have to be harassed and threatend anymore.
Please let my know the information as soon as possable

Please Steve, will you make the information available so that the rest of us who wish to do so, can bring such a suit against our own HOA. The HOW of this is very important.
We are just now forming a grass roots group here in the Palm Spring, CA area and we are willing to work on educating people as to WHAT and HOW they can fight against their HOAs. We now have the attention of a small news paper, as well as a producer who wants to do a documentary on HOAs - I will be meeting with her, and the woman who found her this coming Friday.
Please, don't forget us now that you have "escaped." :>)

I found your articles on the HV webpage and have now seen your work on the AHRC webpage and you are the man!
I'm tracking your case as is my lawyer in our upcoming fight with my HOA and your progress is going to help in the future get our homestead control back from these little Stalin wanna-be's.
Keep up the good work and good luck winning one for all the little guys that have the truth on their side.

Do you have any files , copies of letters and lawsuits you might share with us to solve our HOA situations?
They would enable me to get started doing the same thing here at Alamo Creek HOA.
If you could send them via email, as text or attachment files I can download, print and use them as a model for filing our own complaints.
I was very impressed by your request to revoke the nonprofit status. This is something I had been thinking about doing here myself.
How, exactly, does one receive this permission? What evidence is required? Is this a court case that you must file?
Please provide copies and additional information. The rest of us lost in the dark forests of homeowner associations can use this as a "guidebook".

This is, in a word, fascinating. After reading this, you won't find us looking for a house in a homeowners association. Thank God we learned what we did, when we did about homeowners associations because we would have been stuck in an HOA for good!!
Thank you for this website and all the information here. We try to send it out and tell all our friends about it because it is why we made the decision not to ever buy a house in an association.
We were spared!
