* HISTORICAL INTRODUCTION Before discussing particular solutions to the foreclosure problem in homeowner associations, it is important to understand, at least in outline, some of the history behind the foreclosure problem. As Winston Churchill said, "Not to understand history, is to relive its mistakes." And mistakes there were. The purpose of briefly reviewing these mistakes is not to drag up dirty linen, but to help prevent similar mistakes in the future.

Homeowner Associations file more than 4000 foreclosures annually near Oakland, Calfornia, mostly against Hispanics. Homes foreclosed on to collect relatively minor debts and massive amounts for foreclosing agents. There is preliminary evidence that supports the allegation that discrimination plays a role in the filing of foreclosures in CIDs

Directors & Officers homeowner association insurance, paid for by the member homeowners, instead of being a shield for homeowners, has largely turned into a sword.
Boards of directors now know that they can break the CCRs, act fraudulently and illegally, and have nothing to worry about, because if a homeowner sues, the board will call on the association insurance carrier to defend them.

An easement is the right granted to a third person to use your real property in a specified manner. An easement may be given, for example, for overhead wires, underground gas, power, sewer or storm drain lines, for sidewalk or street purposes, for neighbors to maintain their views, or even for airplanes to fly over your home on a regular basis. The latter right refers to an avigation easement, which is sometimes called an air easement or aircraft easement.

Why are Association Board Gangsters allowed to have slush funds to defend its violations? Namely; these violations include their breach of official responsibility, failure to keep within a budget, exhibiting deception both verbally and written to its members, and acting maliciously and discriminatory in exercising its authority towards its members. The homeownermembers do not have affordable remedies against these Gangster Associations.
The State should revoke many of these non-profit franchises for failure in following corporate formalities.
