Torrey View Homeowners Association board is issuing "parking violations" for parking on our private driveway

Can they change CCRs and then fine us for using our own driveway?

Do you know what the laws are surrounding Parking, in the following scenario Torrey View Homeowvers Association in San Diego County :

Our CC&R's require that the owners gargage is used to the available capacity. The board of directors in our community decided to amend the rules and require that homeowners obtain a "parking variance" in order to use one's own driveway or park on the community streets in guest parking.

Our issue is that we recently purchased our home, read the CC&R's in advance and have just been made aware of these homeowner association board of directors amendments. We are appalled that we cannot park in our own driveway, even temporarily without receiving a parking violation.

Our thought is that we pay taxes on the property we live in including our diriveway . We understand the need to regulate parking on the streets of the community, but we can not see how the BOD can stop us from using our own driveway.

We would appreciate any input. We have been asked to appear at a hearing to determine the boards action regarding our parking violation.

Is anyone famiuliar with or does anyone know how to fight this issue.

We have 3 cars and a 3 car garage. The third car gargage is only large enough to store a small sports car or golf cart.
