Read below about the CAI (Community Associations Institute-Chubb Insurance) case against Sandy Leonard, a shy child in-home care provider for about six babies and toddlers.
Judge Tony Lindsay, wife of Rep. Jon Lindsay, reportedly, dozed, snored and at one time awakened just in time to catch herself before dropping to the floor during Sandy Leonard's trial.
Upon awakening, she denied presentation of a petition signed by 191 of the 206 owners in Normandy Forest stating that they thought the care given by Sandy Leonard to small children was a benefit to the community and was not a nuisance.
Also, the judge denied the evidence that Leonard was being targeted by developer Ken Streeter since fifteen other businesses existed in the sub-division without harassment or lawsuits.
Streeter, according to records, owns the majority of votes in the sub-division which means that owners' votes have no weight. He makes all the rules, owners have absolutely no rights, as is true in sub-divisions with CAI Homeowner Association management.
Judge Lindsay is known for delaying decisions for a day and giving rulings by phone to the lawyer because, according to reports, she does not like the emotional outbursts in court.
The attachment mentioned above, was released before the trial and it was critical of the judge for not having the courage to face the victims of her rulings. Obviously this criticism was read by the judge, prompting her to go ahead and give her ruling on the same day.
The outburst was tearful and unbelievable, Leonard's father almost collapsed with a heart attack, Sandy and all her friends in the courtroom, along with mothers of her in-home day care , were crying and emotionally outraged at the injustice of the judge. one witness said, "It's obvious why the judge slept through the trial, she did not want to be concerned with the facts".
Sandy Leonard writes to the Property Rights Foundation, "On Wednesday, January 10th, I lost in a court of law. I owe $19,000 to Normandy Forest Homeowner Association's CAI lawyer and $10,000 to my attorney. To appeal it would cost me $10,000 and $30,000 to appeal and stay open through trial.
Justice was not served on our day of trial. Judge Lindsay would only let me say 'yes' or 'no' and when I tried to explain about the neighborhood and that it was full of other businesses she jumped down my throat.
She must have had a big lunch because after the lunch break she slept in her chair the rest of the time till she called another break. I do mean she slept! Snoring. She almost fell off her chair. I have 20 witnesses. She rushed the trial through. She rendered her verdict when the lawyers did their closing arguments. She had her mind made up before the trial started. I didn't stand a chance. Not only do the children in my care only have a short time in my care, I owe an unreasonable amount of legal fees and I will not have a job"
"This is a well known tactic", notes Geneva Kirk Brooks. When a home is targeted to be seized a trumped up charge is made, a huge legal fee which is impossible for the victim to pay is imposed. and if the victim does not pay his house is foreclosed.
This racket needs to be investigated by the FBI under RICO laws.

Title: "It Takes a Village"Care of Seven Kids Causes Lawsuit
Seven small kids in private home care causes HOA ruckus. Over one hundred ninety out of two hundred six homeowners in Normandy Forest sub-division, signed a petition - they want Sandy Leonard to keep giving this small community her child care service so that children will be able to stay near home.
Leonard is the typical necessary element in helping to raise a child in a village as epitomized in Hillary Rodham Clinton's book, "It Takes a Village" to raise a child. She provides good, near home, care for small children of mothers who work. She only cares for seven little kids.
Leonard has no signs outside. She keeps children in her home or in the backyard. At most, only seven cars come and go each day. Neighbors say the service is a blessing not a curse. Sandy Leonard (Phone 281-651-177) writes to Geneva Kirk Brooks, Director of Property Rights Foundation:
"I am so scared. The court case is set for Wednesday but Judge Toni Lindsay will not give her verdict until late Thursday over the phone. She does it this way because she can't stand to hear the emotional outburst. I would prefer a verdict in the courtroom".
Leonard is like the more than 4,000 owners in Harris County who have run afoul of Homeowner Association's petty unconstitutional rules and regulations which could cause them to lose their homes.
Judge Patrick Mizell said of Bill 204 which allow such lawsuits " Its crazy, unfair, unconstitutional. I feel so sorry for all the people who suffer and lose their homes under this unconstitutional powerful statute".
Leonard continues to say, in her letter, "I have fought for eight months for my right to care for children near their homes. It is very emotional to me. Our HOA does not listen to what the residents want. The HOA change the by-laws without amending the restrictions. They are unreasonable in many ways, for example, they only allow white curtains and mini-blinds. When a board member's term is ending, he is nominated again by the board, and the developer who holds the majority of the votes him back in. Owners votes count for nothing. Owners have no say so".
This case will be filed along with the outcome and the Judge's decision on January 18, 2001, with The ACLU (American Civil Liberties Union) for their records. They have entered the battle for property rights.
Also, it will be filed with American Veterans in Domestic Defense (AVIDD) an organization under the command of retired 4-star Marine General Raymond Davis, Washington, D.C. The Houston chapter is under the local command of Jim Cabaniss (Phone: 281-872-0706), who says, "When we took our oath upon entering service, we swore to protect our country against all enemies foreign and Domestic.
We talked to General Davis, and he told us to join you, Geneva, in the war for property rights.
General Davis says of the domestic enemies who are taking over America through seizure of property that veterans have proven their loyalty to our country, are strong, dependable, huge in numbers, and have camaraderie and fight without fear. They will be as pleasant as possible, but will be as aggressive as is necessary and as the law allows. Money talks and veterans will make it unprofitable for domestic enemies to oppose their nationwide group".
We are asking that the governor, all senators and representatives write to us so that we can quote their opinions as to the constitutionality of this law and whether or not they will work to repeal all of House Bill 2152 and will work for property rights.
We need their letters on file so that we can work to get this information to all voters and homeowners in Texas who wish to preserve property rights.
Our Texas Constitution says that foreclosures can only occur for unpaid taxes, or unpaid mortgage loans and home improvement loans. Voters want to vote for an amendment to the constitution if any other reason for foreclosure is to be added to our Constitution.

GENEVA KIRK BROOKS, respected educator, anti-pornography warrior, property rights activist, real estate entrepreneur, died August 2, 2002, at M. D. Anderson Cancer Center. She was 79.
Geneva and her team of advocates and reporters generated a national frenzy over the "Texas Foreclosure Rackets."
Senator Jon Lindsay accused her of slandering his and his wife Judge Toni Lindsay's reputation.
To diffuse publicity, he announced State hearings and appointed foreclosure lawyers and some homeowner lawyers to hold private meetings and propose new laws.
Texas activists report that Lindsay and fellow lawmakers continue to preserve laws that let foreclosure lawyers take homes in homeowner associations for a song.
