On The Commons is a weekly radio show dedicated to discussing the many issues surrounding mandatory homeowner associations, the fastest growing form of residential housing in the nation.
We've all been informed, at some point or other, that homeowner association board members can do "anything they want" -- We've also been led to believe that associations have unlimited powers, that even the Constitution can't come between a homeowner and the association. But are associations really all that omnipotent? Is there any hope or help for the individual homeowner?
On The Commons with me this week is David Kahne. David is a Constitutional attorney in Houston, Texas who was recently appointed to a Texas Senate sub committee tasked with looking into the many problems involving homeowners' associations. We'll get an update on what the committee is doing and we'll talk about his constitutional challenge to part of the Texas statute.
