To: All those hard working home owners who are struggling against the foreclosure racket in Florida and NATIONWIDE.
Widow Wenonah Blevins' win of $300,000 and her house back against the Community Associations Institute (CAI) - Chubb Insurance Co foreclosure racket shows owners and lawyers that the foreclosure racket can be brought down if we have the will and good constitutional lawyers like Marion Rosen, David Kahne and Gregg Gladden of ACLU in Houston to fight for us in our courts.
PROPERTY RIGHTS FIGHT WILL BRING ACLU INTO FOREFRONTAGAIN AS THEY WERE DURING THE CIVIL RIGHTS MOVEMENT WHEN THE ACLU WAS SO ACTIVE WINNING SO MANY DISCRIMINATION CASES AND GETTING ANTI-DISCRIMINATION LAWS PASSED.
Lawyers nationwide will begin to take homeowner cases against the foreclosure racket on a contingency basis when they see that these cases can be won and won big and when they find out that the CAI is no longer protected by the deep moneyed pockets and long protective arms of the mighty Chubb Insurance Corporation - one of the world's mightiest.
Remember, fellow braveheart warriors and victims of the foreclosure racket, the secret is to get constitutional lawyers. Where do you find them? Not every lawyer knows how to fight on U.S. Constitutional grounds just as not all doctors know how to perform open heart surgery. Most constitutional lawyers are found connected with the American Civil Liberties Union (ACLU).
Contact the American Civil Liberties Union (ACLU) and tell them you want a hand, not a handout, and that you are willing to pay for their services if you can get a lawyer. ACLU lawyers are practicing lawyers and in extreme cases will act pro bono. If there is a problem in any community where owners' rights are being abused, contact all owners, join together, get a constitutional lawyer and share in the expenses in a class action lawsuit.
David Kahne, a Houston ACLU lawyer, at present is representing forty owners in such an action. He is constantly consulting with other groups. Don't "go it alone" against the CAI-Chubb foreclosure racket- get all the owners in the community with the same complaint to join with you in a group.
Owners should try to get the lawyer to take the case on a contingency basis with an initial retainer fee. Take information about the Blevins case to the lawyer to show how these cases against the foreclosure racket can be won.
Watch for the decision in the 6th Appeals Court in Texarkana with regard to the constitutionality of the law signed by then Governor George Bush which was drafted by CAI lawyer Michael T. Gainer, passed on a voice vote with no record of who voted, in the last ten seconds of an extended thirty minutes of a waning session in a near-empty chamber, without debate, reading, recommendations or committee study.
This law in Texas, trashes the Texas and U.S. Constitution as well as all our homestead laws. Judge Patrick Mizell of Houston says of this law, "Its crazy. Its unfair. Its unconstitutional".
2001 was a banner year in wins by owners in Texas against the foreclosure racket. Remember, fellow warriors, just one win in any state, helps the nation.
To begin with, the Chubb Insurance company, the "enablers" of CAI to foreclose for "legal fees", to file "non-judicial" foreclosures which are directly in violation of the U.S. Constitution's "due process" protection and to run rough shod over all home owner rights, has in Houston, according to Marc Markel, the head snake of CAI-Chubb lawyers, announced that they are no longer going to insure Board Members of homeowner associations.
THIS IS GREAT NEWS. THANK GOD ALMIGHTY!
Now we can go after unscrupulous board members and teach them the meaning of our TexMex yell, "Don't mess with Texas - Don't Tread on me" because board members have had the rug of protection for their evil deeds yanked out from under them. PRAISE THE LORD!
Chubb Insurance always pledged their "duty to defend" boards no matter how right or wrong, moral or immoral, fair or unfair, constitutional or unconstitutional or legal or illegal boards might be in their actions against owners. THIS WILL BE NO MORE!
As we get momentum built across the nation, 2002 will be even a greater year.
Here in Texas we will get a vote from legislators as to whether or not the "bar association" of lawyers will be allowed to continue to operate with "business as usual" or be allowed to "sunset" and go under professional regulations like doctors and teachers. We must sunset the bar. It only takes 85 legislators to sunset the Texas bar. We cannot fail in our efforts to sunset the bar. Texas cannot continue to endure our present legal tyranny with no state oversight or regulations, allowing a "brotherhood" of lawyers to "self-regulate" themselves in secret committees at which victims are never, ever allowed to appear to testify and present evidence - WHATEVER HAPPENED TO THE NOTION EXPRESSED IN THE U.S. CONSTITUTION THAT EVERY PERSON HAS THE RIGHT TO FACE HIS ACCUSER, AND TO RECEIVE "DUE PROCESS"?
Let's work together, get property rights websites in all states, distribute our messages and information on the internet so all may be guided, advised, kept informed and collectively bonded in our fight for our property rights which under the U.S. Constitution, next to liberty itself, is our most precious and most protected right.
We are losing our properties unconstitutionally. We must fight. We have a case to test foreclosures constitutionality in Texas 6th Dist Court
