In Essex County, Massachusetts, a group of lawyers supported by several state and federal judges, after having stolen over $800,000 using invalid court orders, is now ready to liquidate and distribute among themselves the rest of the estate of 87-year-old Mary Jane Chalupowski, still worth about $1,500,000. In some instances the white-collar criminals are seen as a new, refined, version of a lynch mob. Justice Thomas says, "the mob I faced carried no ropes or guns ... its weapons were smooth-tongued lies ..." Justice Thomas is not alone. On November 5, 2007, in the midst of the second blitzkrieg, Chester and Margaret learned that Judge William Young of the United States District Court for the District of Massachusetts reconsidered his January 8, 2007, decision, overturned his own dismissal of their RICO case, and allowed the case to proceed. On November 15, 2007, the Boston Office of the U.S. Marshal started serving the RICO complaint on the sixteen defendants. The message transmitted shortly thereafter to several media outlets reads: "Civil RICO Suit Names Thirteen Lawyers and Three Judges in Staged Litigation Scheme." To be continued.

Barack Obama for the first time on Friday overtook Hillary Clinton's support among the unelected "super-delegates" who will ultimately settle the Democratic nomination amid signs that people around Mrs Clinton were pushing for her to become Mr Obama's running mate. Friday's flurry of support for Mr Obama coincided with a number of possibly unauthorized efforts by senior backers of Mrs Clinton to push forward the idea of Mrs Clinton becoming Mr Obama's vice-presidential running mate. A number of senior Democratic figures have recently come out in favour of a "unity ticket" to help breach the demographic divisions among the Democratic electorate and in order to help prevent a potentially damaging extension of the nomination battle. But it was clear that supporters of Mr Obama were far less enthusiastic about the prospect than supporters of Mrs Clinton. Some believe that having an African-American and a woman on the ticket would be far too risky. Others are bitter about the way Mrs Clinton has run her campaign. "I don't think it is possible," Ted Kennedy, the Massachusetts senator and Obama supporter, told Bloomberg TV. "[Obama should choose someone] in tune with his appeal for the nobler aspects of the American people. If we had real leadership - like we have with Barack Obama - in the number two spot as well, it would be enormously helpful."

In September 2004, using fraudulently procured court orders, an influential lawyer of Beverly Massachusetts instructed several financial institutions to liquidate and give him over $500,000 from bank accounts belonging to three private individuals. When the owners of the funds complained to the courts and law enforcement authorities about the theft, the lawyer procured yet another court order which forbids his victims to undertake any attempts to recover their money. The victims, determined to recover their money despite the existence of the bizarre order obstructing their access to courts, asked the U.S. District Court in Boston to allow them to pursue a civil RICO claim against the influential lawyer and a dozen of his equally influential colleagues, all of whom benefited from or participated in the distribution of the stolen funds. The civil RICO claim assigned to Judge Douglas P. Woodlock seemed to be going forward until Judge William G. Young took over the case and promptly dismissed it in violation of law and rules of civil procedure on January 8, 2007.

Two former executives of a now-defunct New York mortgage lender were on Thursday charged by US officials with fraud in schemes directed at Fannie Mae, the government-sponsored mortgage financier, and Credit Suisse First Boston. In an indictment filed on Thursday, prosecutors alleged that Leib Pinter, a former officer of Olympia Mortgage, which was based in Brooklyn, defrauded Fannie Mae of more than $44m by keeping money intended to pay off refinanced mortgages. Barry Goldstein, also formerly of Olympia, was accused of directing the creation of "dummy" loan histories for mortgage loans sold to Credit Suisse. The charges filed by the US attorney's office in Brooklyn come amid speculation by industry analysts that widespread fraud preceded the subprime mortgage collapse......Knowing that Credit Suisse may not buy the non-performing loans, Mr Goldstein allegedly told other Olympia employees to create "dummy" loan histories to make it appear as if all payments had been made on time. Credit Suisse purchased 12 of these loans. The various schemes lasted from about 1994 to 2004, when Olympia surrendered its mortgage lending licence, according to the indictment. Both men face a maximum of 30 years in prison if convicted, prosecutors said.

One of the Middle East's largest private equity companies has been quietly buying farmland in Pakistan as part of plans by the United Arab Emirates to increase food security and to damp inflation. Dubai-based Abraaj Capital says it is working with the UAE government on the strategic agribusiness investments in Pakistan. The government in Abu Dhabi has been holding talks with Islamabad about a framework for investment in its agricultural sector as it seeks to secure cheaper long-term supplies of staples such as wheat and rice.....Abraaj Capital, which manages $5bn of assets across the Middle East, North Africa and the Indian subcontinent, has been purchasing land in Pakistan during the past year, a company official said. UAE state and private entities intending to build agribusinesses in Pakistan have acquired as much as 800,000 acres of farm land, he said.

Barack Obama's sweeping victory in the North Carolina primary and the narrow defeat in Indiana appeared certain to extend his almost unassailable lead in the Democratic nomination race as it emerged that Hillary Clinton had lent her campaign a further $6.4m. Mr Obama won by 14 percentage points in North Carolina, while Mrs Clinton prevailed by just two points in Indiana. The results appeared certain to extend Mr Obama's almost unassailable lead in the race for nominating delegates and further lengthen the odds against Mrs Clinton snatching the nomination. Mr Obama described his North Carolina win as a triumph against the "politics of division and the politics of distraction" after a fractious fortnight of racially charged debate. "Tonight we stand less than 200 delegates away from winning the Democratic nomination for president of the United States," he told a victory rally in Raleigh, signalling confidence that the race was drawing to a close

The "good ol' boy" network is getting nervous. I have announced the desire to update things, be more open with the membership and stop treating the membership as "cash cows". For decades now, some federal judges have taken it upon themselves to pronounce and rule on matters that were never intended to be heard in courts or decided by judges. With a presumption that would have amazed the framers of our Constitution, and legal reasoning that would have mystified them, federal judges today issue rulings and opinions on policy questions that should be decided democratically. Assured of lifetime tenures, these judges show little regard for the authority of the president, the Congress, and the states. They display even less interest in the will of the people. And the only remedy available to any of us is to find, nominate, and confirm better judges. Quite rightly, the proper role of the judiciary has become one of the defining issues of this presidential election. It will fall to the next president to nominate hundreds of qualified men and women to the federal courts, and the choices we make will reach far into the future.

It is a Crime against Humanity to steal properties and their equity, and to then share this bounty as "political contributions". This has been happening in California for more than 25 years and is a classic example of the abuse of power by a powerful goverment. It created homeowner associations and imprisoned Californians in them.

The 3rd U.S. Circuit Court of Appeals this week threw out a ruling by U.S. District Judge Arthur J. Schwab, saying he copied his opinion "nearly verbatim" from a proposed opinion written by lawyers for the defendants. The court wrote: "Courts and judges exist to provide neutral [forums] in which persons and entities can have their professional disputes and personal crises resolved," Nygaard wrote. "Any degree of impropriety, or even the appearance thereof, undermines our legitimacy and effectiveness."

"Privacy is the right to be alone the most comprehensive of rights, and the right most valued by civilized man." When Justice Brandeis penned those words he did not live in a homeowner association.
Owners of deed-restricted homes and property in common interest developments are at the mercy not only of the homeowner association and boards of directors but also third-party vendors hired by the board, including management companies, consultants, and attorneys, all of which can affect the owners' quality of life.
