Insurance Fraud - Negating Accountability

Georgia Insurance Commissioner John Oxendine

Atlanta, Georgia - In an article written by James Salzer, published in the Atlanta Journal Constitution (AJC)
, specifics regarding a report published by the GA Department of Audits following an audit of GA Insurance Commissioner John Oxendine's Office, noted particular recommendations with regard to reporting, processing, and prosecuting fraud cases.

The article discloses the abysmal effort or lack thereof to address insurance fraud, affecting American homeowners, economics, and even insurance interests. Salzer writes, "A special state insurance fraud program with a $3 million budget investigates few cases and often lets the four-year statute of limitations run out on cases before any action is taken, according to a new state audit." GA Insurance Commissioner Oxendine a former Democrat turned Republican during the Zell Miller (a Democrat turned Bush Republican) years of GA Politics, is a GA BAR Member like his father, Gwinnett Superior Court Judge James W. Oxendine, a longtime Democratic Party activist. Oxendine's political aspirations did extend beyond the current Insurance Commissioner stint, but resulted in a failed campaign Lieutenant (Lt) Governor, (Gov) which coincided with a messy issue involving a well publicized and impromptu arrest, of campaign contributors opposition as reported.

Noted in the recent audit of the Commissioner's 'Special Fraud Program' is, "the decade-old program," which has ONLY forwarded 17 insurance fraud cases to be considered for criminal prosecution in fiscal 2006, during the period of review the subject report covered. And though over $1 million was expended on investigations of insurance fraud, the GA Department of Audits found only one case Oxendine's Office fully investigated for fraudulent financial reporting during the entire year! Noted were 203 cases, listed as "resolved" by the 2006 'Special Fraud Program' results, while 68 percent were closed or NEVER investigated, because the 'statute of limitations' was allowed to toll the matters. Who says college or at least law school does not prepare one for the future, particularly in politics! Leaving even Oxendine to admit, "Clearly, the majority of cases that come to the department are not prosecuted. These cases are white-collar crimes." Despite the color, Oxendine, a former candidate for Lt. Governor, has undeniably lost focus of the tasks and mission, required for even his current position.

In contacting the GA Department of Audits, the focus of their effort was defined as solely to report and publish recommendations, the Commissioner can choose to implement or potentially ignore. If violations of law are discovered, those occurrences are reported to the GA General Assembly or the GA Attorney General(AG). Georgia House Appropriations Chairman Ben Harbin (R-Evans), who is an insurance industry insider was quoted in the AJC Article, acknowledging some funding requests were denied Oxendine stated, "But if he is investigating, why aren't we getting prosecutions? If he's letting the time expire, he's got some explaining to do." So what happens, when cases are not reported or investigations are either stalled or abandoned by the Commissioner's Office based on political correctness, judicial activity, and/or legislative involvement? Calls to Representative Harbin's Office were unreturned.

When my husband a LtCol in the United States Marines Corp, reported to GA Insurance Commissioner Oxendine violations of GA Law by the military officer's insurance corporation (USAA), Oxendine called for an investigation. After review of the USAA's effort to cancel insurance with 1 claim in 11 YEARS, in violation of Georgia Law, Oxendine's group did not generate any correction. Conversely, the result instead was the rescinding of coverage, the reaction identified as emanating from an increased risk posed by a British Neighbor, listed on billing records for the Brock Clay Calhoun (BCC). Oxendine assured the matter would be resolved, along with more than 5 staff members attending the meeting. But in keeping with Oxendine's lack of regard for 'white collar crimes', the matter was never investigated.

Specifically, the use of fraudulent litigation in the name of a dissolved corporation (LMHA, Inc.), initiated by Chuck Clay's partner Richard Calhoun on behalf of the Clay at the time was our State Senator, former head of the GA Republican Party, and the head of the Bush/Cheney Election Campaign, would also NOT be investigated. Oxendine, who did not complete the USAA Investigation or further prosecution, instead sought the Republican endorsement for Lt Gov, against Abramoff connection Ralph Reed.

Subsequently, Oxendine would assert void Orders by Judge Adele Grubbs, negated his ability as Insurance Commissioner to uphold GA Law, despite his mandated duty and official capacity. Could any judge's Order change the illegal acts carried out by USAA, or Oxendine's mandate to uphold the law? No of course not, but the enforcement by the legislature and AG was apparently negotiable and/or selectively enforced particularly with the imposition of the '4 corner stall', as the law bore no weight in the matter.

So imagine our shock, when in 2003 Judge Grubbs issued an Order on behalf of a dissolved corporation and 2 corporate entities my husband and I had created. The billing records submitted by Brock Clay Calhoun (BCC), in the court record, listed their client as our corporation LMTHA, and included a charge for the phone conversation I had with then State Senator Clay, notifying him of fraud.

To add insult to injury, our corporate name (LMTHA), was used to sue US by our State Senator's law firm, BCC. And to date, Commissioner Oxendine has NOT investigated or referred for criminal charges, those fellow BAR Members involved: John Wells, Richard Calhoun, Anthony Denapoli or the law firm of BCC, all of whom participated in using an insurance policy rendered by Nationwide Insurance AGAIN in the name of OUR OWN CORPORATION (LMTHA), NEVER a BCC Client, to generate abusive and fraudulent litigation against us and our assets! Additionally, Nationwide Insurance was repeatedly notified of the fraud, so much for 'good or even clean hands!'

This issue repeatedly raised has yet to be fully addressed by GA AG Thurbert Baker, the GA Legislature, Congressman John Conyers, Senator Patrick Leahy, and/or the Department of Justice, all the while, American homes, security, identities, health and life's works are literally being stolen by veterans and law abiding citizens, using overt and rampant fraud. But hey, it's JUST "white collar crime," and the economic destruction of a nation at issue! Will the lack of international and economic confidence restore a nation's conscience and accountability? Something must!!!
