Dear Representative Harbin,
Since I do not reside in your district, as a courtesy I am copying Representative Jeff Lewis, my elected member of the GA House, by mail since his fact sheet on the General Assembly website does not list an email address. As you know, Rep Lewis serves with you on the Appropriations Committee, Energy, Utilities, and Telecommuncations, and the Ways and Means Committees. Additionally, I am copying AHRC News Services, James Salzer of the Atlanta Journal and Constitution (AJC), my wife, and Commissioner John Oxendine.
I am writing to you as a citizen who was impressed by your stance in the James Salzer article in today's AJC. http://www.ajc.com/metro/content/printedition/2008/02/06/fraud0206.html
In regard to the repeated apparent failure of Commissioner Oxendine's staff to investigate and prosecute instances of insurance fraud, you were quoted as saying, "But if he's investigating, why aren't we getting prosecutions? If he's letting the time expire, he's got some explaining to do."
As you can see from the brief email below, sent to Commissioner Oxendine today, I have previously notified the Commissioner of a case of insurance fraud. For your convenience, I have attached the September 21, 2007 letter referenced in my email to Commissioner Oxendine. Please pay particular attention to the last paragraph on page 3, which continues on page 4. In a nutshell, my wife and I legally formed, and still own, a Georgia Corporation named Lost Mountain Township Homeowners Association, Inc. (hereinafter LMTHA) A man named Ronald Cannon, with the assistance of attorney Richard Calhoun (of Brock and Clay) illegally used our corporate name to obtain a $1,000,000 insurance policy in the name of LMTHA. Mr. Cannon used his own home address as the corporate address. Over the past 8 years, attorney Calhoun and others have used claim funds from the insurance policy for the purposes of litigation against me and my wife. To date, this insurance fraud and corporate identity theft has cost my family in excess of $1,000,000. Additionally, directly due to these fraudulent efforts, we have been forced from our former home in Cobb County and are facing the same prospect at our farm and current residence in Bartow County. If that occurs, our damages will exceed $3,000,000. Furthermore, as a direct result of this fraud, we face possible incarceration for our steadfast defense of our Constitutional Rights in that Judge Adele Grubbs has conspired with Mr. Calhoun in order to force us from our home, an illegal taking of our money, and to illegally order our incarceration for alleged civil contempt, all in violation of our federal due process rights.
We have notified Nationwide, on several occasions, of the fraudulent policy. However, it is still in effect today. Commissioner Oxendine has a duty to investigate this matter and file appropriate criminal charges. Unfortunately, his office has remained silent on the matter. As this is a continuing fraud, statute of limitations is not an issue.
My wife, Taffy Rice, and I stand ready to testify before the Insurance Committee of the GA House of Representatives and provide evidence, from court records, which undeniably proves our claims. In fact, a copy of the actual insurance policy was provided to us in discovery by attorney Anthony Denapoli. The policy shows our corporate name, with Mr. Cannon's address. The discovery response, provided by Mr. Denapoli, also indicates the policy was used against us in litigation. Sir, this is an open and shut case, but my family, as the victims, are the ones being made to suffer.
We face losing everything we have ever worked for due to crimes committed by certain citizens, attorneys, and judges. Please contact us for a meeting and/or testimony, at your earliest convenience. On September 22, 2007, at the monthly Bartow County Republican Party meeting, I discussed a case of insurance fraud with you. At that time I hand delivered to you a letter outlining some of my claims and evidence.
You indicated to me your amazement that a situation such as this could take place. It was my understanding you would begin an investigation. Considering this morning's AJC article, by James Salzer, I am concerned with the lack of contact by your staff.
Please advise me of the status of the investigation into Nationwide Insurance, the law firm of Brock and Clay, and the fraudulent theft of the corporate identity of the corporation owned by me and my wife. For your convenience, I am available to provide ample evidence for investigation and prosecution of the crimes by which I have been victimized.
