Ongoing Denial of Due Process by Georgia Judges
Political Corruption and Judicial Misconduct!

Dear Inspector General Fine,
This week marks two anniversaries relevant to this letter. Monday, September 17, 2007, was the 220th anniversary of the signing of the U.S. Constitution, a tragedy considering the three branches of government refuse to honor and enforce the most important document in American history. Also, today marks the 6-month anniversary of my Civil Rights complaint being filed with you, which was dated March 21, 2007. You received an emailed copy of the letter on March 21, 2007(which your office acknowledge via return email) and a hard copy via Express Mail on March 23, 2007. Sadly, but true to form, I have received no response from you or your staff regarding your binding Constitutional duty to investigate such complaints involving civil rights violations committed by members of the Department of Justice. As a preface, let me assure you all allegations contained in my first letter, and this letter, are clearly shown in the public record, to which I will gladly direct you at your convenience. You certainly do not need to be reminded of your legal mandate, as published on the DOJ website. But for the benefit of the copied recipients I submit the following quote:
"The Office of the Inspector General (OIG) investigates allegations of fraud, waste, abuse, and misconduct by Department of Justice employees, contractors, and grantees. The OIG is an independent entity within the Department of Justice that reports to both the Attorney General and Congress on issues that affect the Department's personnel or operations. The OIG has jurisdiction over all complaints of misconduct against Department of Justice employees..."
My March 21st letter was addressed to Secretary Chertoff, due to violations of the Patriot Act, by then-Georgia Senator Chuck Clay. However, you were a copy recipient due to the violation of my family's civil rights by Judge Adele Grubbs, of the Cobb County, GA Superior Court. The letter was also copied to Speaker Pelosi because Judge Grubbs is a Speaker-appointee to the Department of Justice Coordinating Council on Juvenile Justice and Delinquency Prevention. Similarly, the letter was delivered to Congressman Conyers, Congressman Coble, Congressman Johnson, Congressman Watts, and Senator Leahy, due to their positions on the House and Senate Judiciary Committees. Additionally, former Attorney General Gonzales received a copy of the letter. I have received no response from any of these U.S. Government officials, all of whom have taken an oath of office to "defend the Constitution from all enemies, foreign and domestic," pursuant to 5 USC § 3331.
Sir, I take the violations of law perpetrated against my family by various government officials very seriously. My wife and I have committed no crime, yet an order for our arrest and incarceration has been three times, allegedly over a fence on our private property of over 16 years. Without reiterating all of our claims, and without delving into the actual details of the fraudulent litigation against us, it should be sufficient to again inform you Judge Grubbs and her associates have committed federal and state felonies against us under color of law. Additionally, Judge Grubbs and her fellow-judges Jim Bodiford, Mary Staley, and Arthur Fudger have committed impeachable offenses against us, which can be verified by simply reviewing the public record of some of the many lawsuits invoked upon my family. Lack of prosecution of these public servants does not change the undeniable fact they are nothing less than criminals in the name of the government, which I have served my entire adult life, as a retired U.S. Marine Lieutenant Colonel and active agent of the federal government. Additionally, we have suffered break-ins and vandalism to our home and vehicles. At one point I was threatened with incarceration over a minor County Code violation regarding home burglar alarms, which actually occurred at a different home in our neighborhood approximately 1.5 miles from our home. When that fact was proven to the Solicitor, using 911 records, the charges were dropped. However, to help show this was simply generated to harass my family, the true guilty homeowners were never charged. This is simply another case of collusion between the fraudsters who sued my family and the local government.
My family is not alone in being victimized. These same judges and some of their associates have similarly violated the rights of other citizens. A viewing of hearing and trial transcripts and various pleadings of the cases of Marla Wright, Wendy Titelman, Bahji Adams, Donna Marie Smith, and Peter Popham, all in Cobb County, Georgia undeniably shows venomous and disqualifying comments by these judges directed toward these victims. The records of these cases, and ours, are replete with examples of mandatory disqualification grounds for all of the above named judges, in addition to fellow judge George Kreeger, Jere White, Kenneth Nix, as well as Judge Pamela South of the Gwinnett County, GA State Court.
Additionally, all of the above victims have either been incarcerated or threatened with incarceration when they have demanded their Constitutional Rights be honored. It seems the violations of rights are more blatant when a party is not represented by a member of the BAR, who could act as a handler in these cases. However, in each of these cases the victims initially employed BAR members, until said BAR members engaged either in misconduct, malpractice, or improper agreements with the opposition. You should know that most of the cases involved either civil litigation or divorce proceedings. These folks, and my family, are not criminals, yet our liberty, livelihood, and the very safety of our children are threatened daily.
In a criminal case, about which I have no firsthand knowledge or involvement, a jury foreman was subjected to verbal intimidation by Judge Grubbs OUTSIDE the courtroom, and thus outside her jurisdiction, for his failure to arrive at the decision Judge Grubbs wanted. On March 26, 2007, my wife, children, and I, along with approximately 30 good citizens from all over the country, met personally with Chairman Conyers. An investigation was promised to look into the literally thousands of due process violations perpetrated in this country. At his request, the Chairman was initially presented with summary information on thousands of cases, with more summaries to follow as the victims are able to prepare them. Later, on May 15, 2007, my family again visited Washington to deliver additional information personally to the offices of Congressman Conyers, Senator Leahy, various members of the Judiciary Committees. We also hand-delivered the information to Congressman Gingrey and Senators Chambliss and Isakson, since they are our elected representatives. Finally, we again spoke with Senator Chambliss about the issue on July 28, 2007, at a local Republican breakfast in Cartersville, GA. Unfortunately, Senator Chambliss claims to be "proud" of how effective our judicial system is. Of course, such a response from a BAR member is not unexpected, as the BAR is very efficient at circling the wagons to keep corruption under wraps. However, as the 6-month anniversary of our meeting with Congressman Conyers approaches, no investigation has commenced, no hearings have been convened, and Congressional staffers have become increasingly rude and belligerent to the victims of due process violations, in what is yet another apparent attempt to protect the guilty, rather than aid the victims.
I have had my wages illegally garnished by a corporation that does not hold a money judgment against me. As you know, by virtue of your Harvard Law background and tenure as a former Assistant U. S. Attorney, this court action constitutes a violation of deprivation of rights under color of law. Although this action was taken by Judge Grubbs and Judge South, it has now been condoned by Federal Judge Beverly Martin and the 11th Circuit Judges Dubina, Carnes, and Fay, via a flippant and improper ruling filed September 13, 2007. Additinally, we have had the name of a legal corporation, we founded, created, and still solely own, stolen and used to sue us. In fact, Judge Grubbs awarded attorneys' fees TO OUR OWN CORPORATION, to be paid by us, even though her Order acknowledged we were the true owners of the corporation. In addition, my career as an Air Line Captain has been threatened by my employer, which happens to be represented by Brock and Clay.
The court record clearly shows no one, other than my wife and myself, has ever had the authority to speak for our corporation. Yet Attorney Richard Calhoun, of the Marietta, GA firm of Brock and Clay and his clients, have conspired to steal our corporation's name, with the full knowledge and assistance of Judge Grubbs. They fraudulently obtained an insurance policy from Nationwide in our corporation's name, but at the home address of Ronald L. Cannon (one of Calhoun's co-conspirators). Then they filed multiple claims on that fraudulent policy to obtain attorneys' fees to be used to further defraud us in Judge Grubb's courtroom. Nationwide has been repeatedly notified of this crime but has continued to underwrite the policy. You will note I am copying Georgia Insurance Commissioner John Oxendine on this letter in order to ONCE AGAIN notify him of the repeated violation of state and federal insurance laws. Alas, he has also failed to take action in the matter. Additionally, I have previously notified the Federal Trade Commission of these circumstances, as identity theft, trademark infringement, and identity theft are involved, with no response.
The safety of my wife and children have been repeatedly threatened. We have been unable to live in our home of over 16 years, due to the threats and actions against us. Due to the current mortgage situation, and subsequent obliteration of property rights and values, we are also unable to sell our house, even at a fraction of the appraised value of almost $600,000. Meanwhile, we pay a substantial portion of our income to maintain a home we have been forced out of. Of course, the safety issue is of much greater concern than any monetary or material harm. Rest assured, I will defend my family's security at all cost, just as I have repeatedly pledged to do for my nation.
Sir, I sincerely hope your failure to respond to and investigate the complaints contained in my previous letter is due to your workload. However, families are being destroyed, homes are being taken, and good folks are being forced into bankruptcy, while you and other officials turn a blind eye, or worse, in some cases actually enable such activity.
