| Marietta, Georgia - A Cobb Superior Court judge will decide Nov. 10 if Calhoun, one of the region's top land-use lawyers, received an illegal favor from the Powder Springs City Council he represents when he struck a deal with it over the use of his helicopter. For the past two years Calhoun, 55, a managing partner in the Marietta law firm Brock, Clay & Calhoun, has battled with neighbors over taking off and landing his helicopter on his property. County officials have warned him in the past that it's a violation of zoning rules to fly and land a helicopter in the residential neighborhood where he lives. County Commission Chairman Sam Olens said Calhoun repeatedly has requested that Cobb change its zoning ordinance, but when officials refused, Calhoun decided to break the rules anyway by entering into the agreement with Powder Springs. The county commission, which unanimously agreed to move forward with the suit Tuesday, is only trying to protect Calhoun's neighbors, Olens said. "We have a duty to uphold the safety, welfare and health of the community. You've got utility lines. You've got structures," Olens said.
