Destroying Property Rights in America

Can there be any question, the core of a fascist or communist society is epitomized by the phrase, 'Do as I say, not as I do'?! Such begs the applicability of current elected officials, and a judiciary clearly out of control. And if accountability is raised, it only takes threats, diversions, or acquiescence to break down obstacles. And just as the founding fathers warned, only those who require liberty, will obtain it. Few have the courage to require such under the right amount of pressure, or do they? We will be featuring a number of key stories about Americans, who believe in liberty and are committed to same. Please keep your eyes on 'Breaking News' for a number of REAL LIFE stories, some are waging to secure hope for American individuals, families, and children!

When Judge Adele Grubbs violated the law (LMHA and the ACC of LMTHA v. Rice), on behalf a powerful and controlling Republican Law Firm, with Democratic ties extending back through history, we learned what some have come to see in the Jack Abramoff Scandal. But Jack has nothing on Glenn, Chuck, and Richard. For you see, a law firm that controls the decisions made by schools, hospitals, power companies, the GA Bar Association, the Chamber of Commerce, the Board of Commissioners, the GA Attorney General, the GA Secretary of State, the GA Insurance Commissioner, the Atlanta FBI Office, the GA Court of Appeals, the GA Supreme Court, Atlanta US Attorney's Office, key development interests, or the Governor, knows no bounds or repercussions! Certainly the law, nor any rule applies to these men of powerful connections, including the Bush White House and Congress, but as for everyone else, you must be quiet and subservient, even if these lawyers aren't! And if you assert your rights, don't forget, we can sue you, have you investigated, damage personal property, and cause bodily damage to your own. Welcome to America, where justice is a concept most of us are still praying for, but connections and money rule the moment.

REPUBLICAN POINT MAN SEEKS TO DESTROY PROPERTY RIGHTS- 'IMPROVEMENT DISTRICTS'

Once again the Republicans have managed to further damage the people they should be serving. Case in point, Senator Cecil Staton, the latest 'Newt Gingrich' prototype. You might remember Staton was a Rome, GA publisher with ecumenical ties, who sought the Congressional Seat obtained by Phil Gingrey, the extensively supported physician turned politician. Gingrey, who found himself in the courtroom of Judge Mary Staley on a wrongful death suit, has been an ardent Bush supporter to include the disgraceful 'Patriot (less) Act'.

In classic 'Newtron' style, Staton relocates to Macon following his political loss in the congressional bid and miraculously gets elected to the GA Senate. During his tenure, he has become renowned for such things as 'eminent domain' legislation and now 'improvement districts', allowing developers to tax residents. It's not enough for legislators like GA Rep. Earl Ehrhart and others to be bankrolled by CAI, mining, gas, banking, and oil interests, but now the developers are actually being given the authority to tax citizens!

Under Staton's treasonous proposal, local governments would approve districts where new housing would be targeted. Ah the opportunities to cash in abound! The district supervisors would be appointed by the developer, to be later voted on by homeowners (an association if you will), to control the rights of all property owners. As if homeowners associations were not in direct conflict with the constitution, we need more developers controlling these unconstitutional bodies, now being handed codified status.

Beyond the handpicked 'associations or districts, supervisors would then be assigned to oversee levying taxes or fees on homes. From those funds, developers would issue bonds and borrow money to build roads, sewers, schools, or other infrastructure concerns. Are you buying this! Well even the Atlanta Journal Constitution (AJC) is reporting the abhorrent nature of this little debacle. While the AJC has little regard for corporate corruption or judicial mischief, don't forget, advertising dollars and control are at stake, and can even affect their corporate bottom line. May God have mercy if this evil stands!

Never shall I forget, while running for elected office in order to disclose rampant and overt corruption, a judicial candidate complaining of campaign signs being taken, as they did not meet 'covenant' requirements in a neighborhood. The candidate by the name of McKinney, immediately stated without hesitation, everyone knows covenants are illegal, as they are a constitutional violation. And while this was a foregone conclusion, such clarity has not been upheld by judges or legislators to date. How can that be? To violate the constitution and act in opposition to the people was labeled as no less than treason by the founding fathers, and some things never change!

But in a recent Cobb County Town Hall Meeting for Commissioner Helen Goreham, it was announced by members of the Cobb Water Department, that the EPD has found fecal choliform levels to be in excess and mandated cleanup. As you might imagine, that and the disclosure of 56 active gangs, do not make homeowners more confident. And then there was the discussion of a multi million dollar trail along a major 4 lane highway to be built against electric transformers to be paid by taxpayers. And as if all that was not more than enough, there was the issue of the "rain tax". A new cost will be imposed upon homeowners to pay for the stormwater managment issue, caused by over development and redirection of surface waters, in violation of law. That's right, every property owner, will incur the cost of subsidizing over development, which the county has refused to enforce or regulate for the last 5 years. Once again instead of accountability, property owners are encouraged to come, build, and we will pay for it, in property taxes, local sales taxes, usage fees, developer imposed taxes (a la Staton legislation, if it passes!), water quality, and health costs! It would seem it's time to whip out the proverbial fiddle, as Rome is beginning to ignite!

'GENTLEMAN JIM' WANTS YOUR VOTE

This election season, Cobb Chief Judge James (Jim) Bodiford is up for re-election. In his initial run, 'Gentleman Jim' was caught for removing the political signs of a current State Judge and former candidate Toby Prodgers, akin to the same type of activity Senator Chip Rogers was reportedly associated with. You will see the Judge visiting among Republican circles, schools, Chamber gatherings, and all the usual controlled groups. Judge Bodiford is even using his wife Nancy, an assistant to the Sheriff, as part of his political collateral.

You might remember Judge Bodiford from several cases of horrendous note. He has been an active part or participant in the theft of sexually abused children, violated by their father (www.wendytitelman.com). And then, there was the nasty divorce matter, in which every violation of law imaginable was perpetrated and upheld by the judge against Marquitta Portman, (www.marquitta.com). But who could forget the discovery of mass bodies not buried as family members were told, but dumped in various locations on a family property, despite the equipment to handle the assigned task properly, (Ray Brent Marsh matter). It was during that case, that Judge Bodiford was asked to step away from presiding over the matter by Attorney Ken Poston. Unfortunately however, it only took the assistance of close and personal friend Judge Jon Bolling Wood from Douglasville, to deny any effort to have Bodiford removed from the case, despite testimony or court records.

Yes, Judge Bodiford has been an active member in so many notorious cases to include the Sara Tokars Murder and countless travesties in violation of court rules, state law, and the constitution of both state and nation. But will he even have a competitor? Don't forget, threats, lawsuits, and economic pressure, can assure the outcome of any matter where members of the connected are concerned. In the last hearing in the matter of Titelman v. Titelman, Judge Bodiford threatened representative counsel with the loss of his Bar Number, regarding a brief that outlined the prior misconduct of Judge Bodiford in the courtroom.

So, when running into 'Gentleman Jim' at a Republican Mass Precinct Meeting, this reporter could not hesitate to directly address, the disappointment and shock with which he had granted 'a special set hearing' for Richard Calhoun, despite a court date already reserved by the Plaintiff. Despite codified law and Superior Court Rules, Bodiford transferred the case assigned to his courtroom to Judge Grubbs, though a Motion to Recuse and Disqualify, in addition to a federal lawsuit, were pending against Grubbs. Beyond the transfer issue, was the horror of incorrect court transcripts taken during the proceeding, or prior prepared decisions conveyed verbally, which the Judge announced, prior to a brief adjournment. Though findings of fact and conclusions of law were requested and granted, Judge Bodiford could not be bothered with rules, and never published same. So much for due process! Welcome to justice, 'Gentleman Jim' style.

WHERE IS AMERICAN JUSTICE OR ARE WE LIVING AS INFIDELS?

Most Americans agree, our society is overwhelming corrupt and based on corporate models. Few elected officials or government organizations appear to have the slightest interest in serving the people. And any effort to address corruption or accountability is immediately diverted or pressured. Several have sought notification to governmental officials and organizations mandated with addressing specific issues. Some of those personal stories will soon be featured.

With the current position of the judiciary as autonomous and legislators complicit in crimes against their own citizens, the American Dream is clearly fading fast. And what does this do for American property owners, mothers and fathers, or immigrants? Spying on citizens, denial of legal redress, and overt theft, are the order of the day it seems. No wonder other countries do not want the exports of our current government. But just wait when the Euro becomes the basic standard for oil purchases and not the dollar. If you think the civil war created a major money making enterprise, it won't be just our ports that are lost.

The press and outspoken Americans have been labeled and punished for what should be free speech. Is there any wonder only a handful of profiteers see the economy as growing and improving, while the average worker remains tense with fear? It's time for Americans to demand our government function properly and refuse to self destruct. Surely no veteran or property owner can abide by such dishonor. Why Porter Goss now wants to prosecute those, who made it known Americans were being spied upon. But the Justice Department so engaged, has no time to handle massive corruption against the people. Instead they are looking for reports of police misconduct alone.

Even Bob Barr has begun squaring off with the Bush Administration. Barr clearly defined the key issue as "whether or not we will remain a nation subject to and governed by the rule of law or the whim of men". While Barr working with Edwin Marger, who represented Curtis Rower, the hitman in the Sara Tokars murder, out of a Jasper law firm can bespeak the obvious, when it came to GA corruption, it was Marger, who advised to just "go home and forget what has happened". Sounds like the whims of men are in the lead and not the rule of law. Clearly all men must serve the people in accordance with constitutional mandates, or be marked as traitors, regardless of position, party, or preference. On that, it would appear at this point, even Mr. Barr agrees.
