Desert Hot Springs, California - These are supposed to be their golden retirement years, but instead some senior citizens in the Desert Crest Country Club mobile home park say they’re living a nightmare.
For several years, they’ve been mired in a dispute -- and lawsuits -- about whether they have to pay monthly membership dues.
Their refusal to pay the dues landed them in court, where judges have ruled in their favor. But efforts by the club’s owner continued, and ultimately the residents fought back.
In a lawsuit that goes to trial in November, 15 residents are asking a judge to award them damages for alleged infliction of serious emotional distress, elder abuse, fraud, misrepresentation and other actions.
Denying the allegations, attorneys for the defendants -- OSCA Development Co., doing business as Desert Crest Country Club, the club’s community association and several individuals -- have tried unsuccessfully to get the suit dismissed.
This month, they will try again to convince a judge the case shouldn’t go to trial.
