Court Documents Charge Homeowner Assocation lawyers Peters & Freedman with Deceptive Billings

Report them to the California State Bar Discipline Committee and the Government Authorities

November 01, 2004

By Willowdean Vance (View author info)

Encinitas, California -

It is imperative for victims of deceptive billing by lawyers to check into the State Bar Discipline Committee Rules, and in the case of Peters and Freedman, check each rule that applies and attach a copy of the court ruling for false billing and the judge that made the ruling.

Then you should congratulate the Judicial Qualification Committee for finding ONE honest judge in California. This will encourage more judges to be honest and make sure the new Bar President John Van de Kamp is in the right camp.

BUT- don't overlook the State Division of Corporations or Secretary of Corporations. Notify them that this law firm or any law firm has violated the 501C State Statutes as they collected large fees to defend a board of directors in a homeowner's association.
It the job of the State Division of Corporations to police each association and make sure they honor all statutes including the one that says, "Treat all members fair and reasonable."

It is not fair or reasonable to keep charging the same fees over and over again. It is fraud. Attach the court ruling as evidence that the firm is guilty of aiding and abetting the HOA Board to violate their duty by using fraud to collect fees already paid....and then send a copy to the FTC under Violations of the Fair Debt Credit Collection Practice Act, Washington, DC.

Your last duty is to hit the attorney general. It does not matter what state you live in - remember the main duty( see job description) of an attorney general is to police all state attorneys under him and make sure each law is enforced. They must also make sure no civil rights are violated. Often, these community developments operate like the mafia to kill all civil rights because they don't have a civil right in their head or heart.

The only might respected is wealth stolen at the expense of your health because too few people know how to use the system. And every single HOA resident should contact their elected official in the state and request a complete copy of the 501 C nonprofit state statutes for common interest development.

Norm Davis and Jan Bergeman have proved that when an elected official is swamped with requests for any one problem, they take steps to erase the problem because they don't want to be tied up or down hearing our gripes.

Career politicians don't run for office to serve--they run for benefits and the richest benefits come from land developers and local commissioners dedicated to tax discrimination until a protest is made.

You work hard for your dollars. Why do you let greedy commissioners steal our money by taking tax for service when you must pay your board to perform without a tax credit?

The Germans say we get too soon old and too late smart so get some smarts on government and outsmart them before they outsmart you.
